Welcome back to the 4th installation of the “Official court of law” for this board. In this thread we will debate and pass judgement on character crimes from the work ASOIAF. As judges we bear a burden of upholding the integrity of our court so being impartial is imperative, keep all arguments in a legal context that suit the standards of this court. All posters are welcomed to make their case, at the end of your argument pass your judgement and sentence!!!!

The rules: Every poster has one vote (per charge) of guilt or innocence.

**For a guilty verdict, your options are:
  • Send them to the wall. (same as prison sentence)
  • Death by sword. (Clean and quick)
  • Death by flames. (An ode to R’hllor)
  • Death by flaying. (oh boy)
  • Monetary fine
  • Exile and/or
  • Stripped of land/title.
  • Prison sentence
**If you find the character innocent, simply state innocent after your argument.
As for as evidence that can be submitted, posters can submit any argument they deem relevant. However we cannot use any pardons or prior convictions as evidence in the matter. Our court will not recognize the judgement of any other court or ruling body.

**You can also vote for charges to be dismissed (majority rule).
**At the end of the week the vote will be counted and the final sentence carried out. Majority rules. Only the nominated character will be discussed, however, you can indict characters you also find culpable, as part of your ruling, and they can be added to the docket.

**Votes can be changed before they are counted, but do so in your original post.
Posters can just cast a vote, which is your right, but try to state a case as well. Your opinion actually matters and it may serve to change the vote of another judge.
*Do not take it personally if your favorite character is being torn to pieces. Everyone is fair game.

****If votes of 'not guilty' and 'dismissed' taken together comprise over 50% of the total votes cast, the defendant is to be found 'not guilty' or the charge is to be 'dismissed', with the option that gained the most votes between the two representing the final verdict.****

This court now call upon the defendant Melisandre, also know as Melisandre of Asshai, The Red Priestess, The Red Woman, and Lady Red. This court hereby charges the defendant with:

1. Conspiracy to commit murder. (Melisandre of Asshai plotted to tortured and kill one Edric Storm, a child of age 12.)

2. Attempted murder of one Edric Storm. Melisandre sought an opportunity to murder Edric, thus establishing intent to carry out the heinous act.

3. Murder of Renly Baratheon Lord of Storm’s End, Master of Laws. (Melisandre used her misguided vision to convince her lord that Renly Baratheon would be victorious at the battle of Blackwater, she then used magic to conjure a shadow baby that executed Lord Renly.)

4. Murder of Lord Guncer Sunglass. (After her lords departure for battle Melisandre tortured and burned Lord Sunglass to send a message to those with different gods and those who opposed her lord.)

5. Murder of Ser Hubbard Rambton. (Ser Rambton was also tortured and burned.)

6. Murder of Ser Cortnay Penrose. (Ser Penrose was murdered by one of Melisandre’s shadow assassins.)

7. Murder of Allester Florent. (Allester Florent worked along side Melisandre and acted with the blessing of Queen Selsye Baratheon. As a reward for his service he was tortured and burned.)

8. Inciting violence against other religions. ( Melisandre terrorizes then sacrifices those who do not wish to abandon the religion of their ancestors.)

9. Vandalism. (Melisandre trespassed onto holy sights and destroyed religious relics throughout the Kingdoms.)

10. Torture. (Melisandre insists on burning her victims alive, even children.)

8. Not Guilty - this isnt even a modern day crime in a lot of places, even in the Western World.

2. Innocent. The defendant did not attempt to kill Edric Storm. She tried to persuade King Stannis Baratheon to allow her to kill him, but she didn't disobey him when he refused.

I find the defendant, Lady Melisandre of Asshai, guilty of all but two of the charges. I do hereby sentence her to death by sword, as I believe that she wouldn't consider burning to be a punishment.

Five charges of Murder: unlawful killing of a human with intent to kill or cause grievous bodily harm.

1. Conspiracy to murder Edric Storm

Guilty. Melisandre was repeatedly heard to state that Edric Storm should be burned.

2. Attempted murder of one Edric Storm.

Not guilty. Intent is not sufficient; she must have started the immediate action of attempting to kill him. While she repeatedly stated her desire to burn him, she made no move actually to do so. Words alone are not sufficient for conviction for attempt.

3. Murder of Renly Baratheon Lord of Storm’s End, Master of Laws.

Guilty. Renly Baratheon was in a state of war with Stannis Baratheon at the time, who Melisandre purports to serve. However, during parley the day before the event, Stannis and Renly agreed that Renly had until dawn to strike his banners and submit to Stannis and that if he did so Stannis would take no action against him. By killing Renly before dawn, Melisandre breached this agreement. That Renly had no intention of doing as Stannis requested is irrelevant: Renly was slain during a period he was told he would be safe from harm.

4. Murder of Lord Guncer Sunglass.

Guilty. Lord Sunglass was not sentenced under recognised proceedings by king Stannis, making Melisandre's killing of him an extrajudicial murder.

5. Murder of Ser Hubbard Rambton.

Guilty. Ser Hubard was not sentenced under recognised proceedings by king Stannis, making Melisandre's killing of him an extrajudicial murder.

(Question of fact: according to the Wiki, Ser Hubard was killed after taking up arms to defend the sept and his sons were later burned. It is for the crime of burning, whoever the victim, that verdict and sentence is passed, not for slayings on the steps of the sept, for which additional charges should be brought).

6. Murder of Ser Cortnay Penrose.

Not guilty. Melisandre was ordered to commit this murder by her king as part of an openly declared state of war between Stannis and Ser Cortnay. Unlike the charge of murder of Renly Baratheon, Ser Cortnay had not been promised safety at the time of his death.

7. Murder of Allester Florent.

Not guilty. Alester Florent was sentenced and executed under recognised proceedings. His death was lawful and therefore not murder.

8. Inciting violence against other religions.

Guilty, by admission.

9. Vandalism.

Guilty, by admission.

10. Torture.

Not guilty. Torture is used in order to extract information from a victim, which was not the purpose of her actions and therefore does not meet the intent condition of the crime. The pain and suffering caused to the victim is incidental to the chosen method of killing and is accounted for within the charges of murder.

Verdict and sentence:

1. Guilty. Sentenced to imprisonment for life.
2. (Not Guilty)
3. Guilty. Sentenced to execution by the sword.
4. Guilty. Sentenced to execution by the sword.
5. Guilty. Sentenced to execution by the sword.

8. Guilty. In lieu of a sentencing option for penance, sentenced to being stripped of title as a Red Priest and associated honours.
9. Guilty. Sentenced to a monetary fine of equivalent value to damage caused, plus a retributive sum of 1,000 gold dragons the precise sum subject to approval of other judges.

Guilty. Punishment: fine (Daenerys should kill him herself). I see no child, only stagspawn.

2. Attempted murder of one Edric Storm. Melisandre sought an opportunity to murder Edric, thus establishing intent to carry out the heinous act.
Innocent. I see barely any difference between this accusation and the one above.

3. Murder of Renly Baratheon Lord of Storm’s End, Master of Laws. (Melisandre used her misguided vision to convince her lord that Renly Baratheon would be victorious at the battle of Blackwater, she then used magic to conjure a shadow baby that executed Lord Renly.)
Innocent. Renly was a usurper.

4. Murder of Lord Guncer Sunglass. (After her lords departure for battle Melisandre tortured and burned Lord Sunglass to send a message to those with different gods and those who opposed her lord.)
Guilty. Death by sword.

5. Murder of Ser Hubbard Rambton. (Ser Rambton was also tortured and burned.)
Guilty. Death by sword.

6. Murder of Ser Cortnay Penrose. (Ser Penrose was murdered by one of Melisandre’s shadow assassins.)
Innocent. Tratior.

7. Murder of Allester Florent. (Allester Florent worked along side Melisandre and acted with the blessing of Queen Selsye Baratheon. As a reward for his service he was tortured and burned.)

Guilty (Insanity): Mel wanted him dead, and pleaded for his life to be ended while also providing a plan for his murder; yet she felt it was necessary for her religion. - Exile

2. Attempted murder of one Edric Storm. Melisandre sought an opportunity to murder Edric, thus establishing intent to carry out the heinous act.

Innocent: She never actually attempted to kill him.

3. Murder of Renly Baratheon Lord of Storm’s End, Master of Laws. (Melisandre used her misguided vision to convince her lord that Renly Baratheon would be victorious at the battle of Blackwater, she then used magic to conjure a shadow baby that executed Lord Renly.)

Innocent: Renly was a traitor to her king and was killed precisely at dawn. There is a difference between dawn and sunrise.

4. Murder of Lord Guncer Sunglass. (After her lords departure for battle Melisandre tortured and burned Lord Sunglass to send a message to those with different gods and those who opposed her lord.)

Innocent: Lord Sunglass was burned alive on the orders of Selyse Baratheon.

5. Murder of Ser Hubbard Rambton. (Ser Rambton was also tortured and burned.)

Innocent: He was not killed by Mel.

6. Murder of Ser Cortnay Penrose. (Ser Penrose was murdered by one of Melisandre’s shadow assassins.)

Innocent: He was a traitor to the king.

7. Murder of Allester Florent. (Allester Florent worked along side Melisandre and acted with the blessing of Queen Selsye Baratheon. As a reward for his service he was tortured and burned.)

I find the defendant guilty of the crimes acknowledged above and sentence her to exile across the Narrow Sea. She is not to knowingly make any further contact with King Stannis nor any other Westerosi.

1. Not Guilty.  A conspiracy requires at least two people to be proved.  What she can be tried for is incitement to murder, on the ground that she urged Stannis to burn Edric Storm.  However, as that charge has not been put forward, she is Not Guilty.

2.  Not Guilty.  Desiring to murder someone is not the same thing as attempting to murder someone.

3. and 6.  Not Guilty.  Assasination of an opposing military leader is a legitimate act of war (hence, President Obama is not on trial for ordering the assasination of Osama Bin Laden).  Furthermore, Stannis is the legitimate King of Westeros, and Renly proved himself a traitor by using force to oppose him.

4. and 5. Not Guilty.   Lord Sunglass had renounced allegiance to Stannis, the rightful King of Westero, and his liege lord.   Ser Hubbard and his sons took up arms against his men.  Therefore, their lives were forfeit.

7.  Not Guilty.  Lord Alester was guilty of treason towards Stannis.  In any event, the execution was ordered by Stannis.

8.  Guilty of incitement to violence towards other religions.  But, I cannot recall her ordering the sacrifice of anyone who had not been condemned for treason, violence against their liege lord, or desertion.  Two years' imprisonment.

On reflection, Rattleshirt was not guilty of  desertion, but he was guilty of multiple murders and rape.

9.  Stannis is entitled to destroy his own Sept.  But she is guilty of acts of vandalism towards weirwood trees in the North.  Two years' imprisonment.

10.  Guilty.  Burning alive is undoubtedly torture.  She can plead in mitigation that she is obeying the orders of King Stannis and Queen Selyse, but superior orders can never be a defence to torture.  Twenty years' imprisonment.

24 years' imprisonment in total.

Guilty, she clearly asked for the boy's life. However, I will merely strip her of her lands and titles, which she doesn't have.

2. Attempted murder of one Edric Storm. Melisandre sought an opportunity to murder Edric, thus establishing intent to carry out the heinous act.
Guilty. However, is this not the same as the one mentioned above?

3. Murder of Renly Baratheon Lord of Storm’s End, Master of Laws. (Melisandre used her misguided vision to convince her lord that Renly Baratheon would be victorious at the battle of Blackwater, she then used magic to conjure a shadow baby that executed Lord Renly.)
Guilty. She was the one who thought of the plan, was full aware what she was going to do and was the one that.. Birthed the shadow. Death by burning, according to her own wishes.

4. Murder of Lord Guncer Sunglass. (After her lords departure for battle Melisandre tortured and burned Lord Sunglass to send a message to those with different gods and those who opposed her lord.)
Not guilty. Selyse was the one who ordered the death of Lord Sunglass, after Stannis had him thrown into a cell. We cannot say with certainty that Melisandre ordered it.

5. Murder of Ser Hubbard Rambton. (Ser Rambton was also tortured and burned.)
Not guilty, since Ser Rambton was killed after he already killed four of the Queen's Men. That is treason which is punishable by death. So it is not a murder.

6. Murder of Ser Cortnay Penrose. (Ser Penrose was murdered by one of Melisandre’s shadow assassins.)
Guilty. See 3.

7. Murder of Allester Florent. (Allester Florent worked along side Melisandre and acted with the blessing of Queen Selsye Baratheon. As a reward for his service he was tortured and burned.)
Not guilty. Alester Florent had committed treason by wanting to make peace with the Lannisters. Treason is punishable by death.

8. Inciting violence against other religions. ( Melisandre terrorizes then sacrifices those who do not wish to abandon the religion of their ancestors.)
Guilty. There is freedom of religion in Westeros and Stannis does not agree with the inciting of violence against other religions. Death by burning.

9. Vandalism. (Melisandre trespassed onto holy sights and destroyed religious relics throughout the Kingdoms.)
Guilty of vandalism, but no punishment needed. She acted on behalf of King Stannis Baratheon.

10. Torture. (Melisandre insists on burning her victims alive, even children.)
Guilty. Death by burning.

-By definitioin, Conspiracy is an agreement of 2 or more parties to commit a crime. since no agreement was achieved therefore
NOT GUILTY

2. Attempted murder of one Edric Storm. Melisandre sought an opportunity to murder Edric, thus establishing intent to carry out the heinous act.
-While the Melisandre had the intent for Edric Storm to die, at no time did the accused act to murder said person therefore
NOT GUILTY


3. Murder of Renly Baratheon Lord of Storm’s End, Master of Laws. (Melisandre used her misguided vision to convince her lord that Renly Baratheon would be victorious at the battle of Blackwater, she then used magic to conjure a shadow baby that executed Lord Renly.)
-While the accused did kill Renly Baratheon, Both Baratheon was at war at that time, and assassinations are part of war therefore

-Alester Florent was judged guilty of treason, crime punishable by death. therefore

GUILTY for inciting violence, however no proof of guilt for commiting sacrifices other that already stated above. Rattleshirt, a.k.a. fake Mance Rayder was not killed because of his religion.

Conspiracy to commit murder.
Innocent. It isn't really a crime to want someone dead and the defendant never did anything to Edric besides Stannis she wanted to kill Edric.

Attempted murder
Innocent. See charge 1.

Murder of Renly Baratheon
Innocent. The assassination of Renly Baratheon was an act of war. A shadow baby assassination isn't all that different than say a drone strike on our world and that is perfectly legal.

Murder of Lord Sunglass and Ser Rambton.
Innocent. Queen Selyse is the one who had them burned. It isn't known if the defendant suggested it or if Queen Selyse, who is rather fanatical herself, did the sees on her own.

Murder of Allestor Florent.
Innocent. Allestor Florent committed treason against his king, Stannis Baratheon, and was executed for it.

Innocent. The defendant hasn't burned anyone who wasn't already guilty of a crime punishable by death and the most she has terrorized people is preach to them when they don't want to hear it.

Vandalism
Guilty in the case of the weirwoods.
Innocent in the case of the sept on Dragonstone. The sept was Stannis's to burn if he wished to.
Sentence, ministry fine of the amount it would take to replant the weirwoods.

Torture
Innocent. Burning is an acceptable method of execution in Westros and she didn't burn anyone who didn't commit a crime punishable by death.

Was having that same feeling also until I remembered how she burned alive people for not casting away their religions and her intent to burn a child alive.

1. Conspiracy to commit murder. (Melisandre of Asshai plotted to tortured and kill one Edric Storm, a child of age 12.)
Guilty

2. Attempted murder of one Edric Storm. Melisandre sought an opportunity to murder Edric, thus establishing intent to carry out the heinous act.
Guilty

3. Murder of Renly Baratheon Lord of Storm’s End, Master of Laws. (Melisandre used her misguided vision to convince her lord that Renly Baratheon would be victorious at the battle of Blackwater, she then used magic to conjure a shadow baby that executed Lord Renly.)
Dismissal.  It was war and Renly Barathein was a traitor with no claim.  By killing him she served her king.

4. Murder of Lord Guncer Sunglass. (After her lords departure for battle Melisandre tortured and burned Lord Sunglass to send a message to those with different gods and those who opposed her lord.)
Guilty

5. Murder of Ser Hubbard Rambton. (Ser Rambton was also tortured and burned.)

6. Murder of Ser Cortnay Penrose. (Ser Penrose was murdered by one of Melisandre’s shadow assassins.)
Dismissal.  It was war and he was on the opposing side and willing to damage his enemies as much as they were willing to destroy him.

7. Murder of Allester Florent. (Allester Florent worked along side Melisandre and acted with the blessing of Queen Selsye Baratheon. As a reward for his service he was tortured and burned.)

HERE'S WHAT I WOULD HAVE VOTED.


1. Conspiracy to commit murder. (Melisandre of Asshai plotted to tortured and kill one Edric Storm, a child of age 12.)
Dismissed - She was acting in accordance with her religious beliefs, and in accordance with her King's Laws. However, the court is unfit to judge issues of what might have been, as this amounts to indulging in prophecy itself.  

2. Attempted murder of one Edric Storm. Melisandre sought an opportunity to murder Edric, thus establishing intent to carry out the heinous act.
Dismissed, same reason as #1.

3. Murder of Renly Baratheon Lord of Storm’s End, Master of Laws. (Melisandre used her misguided vision to convince her lord that Renly Baratheon would be victorious at the battle of Blackwater, she then used magic to conjure a shadow baby that executed Lord Renly.)

Guilty - The victim has destroyed holy relics and decerated holy sites of other faiths.

10. Torture. (Melisandre insists on burning her victims alive, even children.)
Dismissed - the court is unable to ascertain whether "death by fire is the purest death".

Verdict:
Counts 3, 6, 8, 9 = GUILTY
Counts 1, 2, 4, 5, 7, 10 = CHARGE DISMISSED
