Welcome to the 7th installation of the “Official court of law” for this board. In this thread we will debate and pass judgement on character crimes from the work ASOIAF. As judges we bear a burden of upholding the integrity of our court so being impartial is imperative, keep all arguments in a legal context that suit the standards of this court. All posters are welcomed to make their case, at the end of your argument pass your judgement and sentence!!!!

The rules: Every poster has one vote (per charge) of guilt or innocence.

**For a guilty verdict, your options are:

  • Send them to the wall. (same as prison sentence)
  • Death by sword. (Clean and quick)
  • Death by flames. (An ode to R’hllor)
  • Death by flaying. (oh boy)
  • Monetary fine
  • Exile and/or
  • Stripped of land/title.
  • Prison sentence

**If you find the character innocent, simply state innocent after your argument.

As for as evidence that can be submitted, posters can submit any argument they deem relevant. However we cannot use any pardons or prior convictions as evidence in the matter. Our court will not recognize the judgement of any other court or ruling body.

**You can also vote for charges to be dismissed (majority rule).

**At the end of the week the vote will be counted and the final sentence carried out. Majority rules. Only the nominated character will be discussed, however, you can indict characters you also find culpable, as part of your ruling, and they can be added to the docket.

**Votes can be changed before they are counted, but do so in your original post.

Posters can just cast a vote, which is your right, but try to state a case as well. Your opinion actually matters and it may serve to change the vote of another judge.

*Do not take it personally if your favorite character is being torn to pieces. Everyone is fair game.

****If votes of 'not guilty' and 'dismissed' taken together comprise over 50% of the total votes cast, the defendant is to be found 'not guilty' or the charge is to be 'dismissed', with the option that gained the most votes between the two representing the final verdict.****

This court call upon the defendant Ser Gregor Clegane, alias ‘The Mountain,’ Knight of Clegane’s Keep and charge him with:

Charge 1) 2 Counts of murder-During a competitive joust Ser Gregor intentionally and successfully sort to cause fatal injury to Ser Hugh of the Vale. Ser Clegane upon invading the Riverlands successfully attacked castle Darry, killing 8 year old Lord Lyman Darry.

Charge 2) Genocide-Ser Gregor Clegane committed unwarranted acts of genocide against the people of the Riverlands.

Charge 3) Rape-Upon sacking Stony Hedge the seat of House Bracken, Ser Gregor Clegane sexually assaulted and raped one of Lord Jonos Bracken daughters.

Charge 4) Slavery-Many survivors of Ser Cleganes’ attacks throughout the Riverlands were taken to Harrenhal Castle, where they forced into labor and abused directly by his command and Ser Clegane himself.

Charge 5) Torture-Ser Clegane stood by while ‘Tickler’ carried out acts of torture at his command. According to witness Chiswyck "Tickler makes them howl so hard they piss themselves..."

Charge 6) Theft-Upon sacking the many castles of the Riverlands Ser Gregor stole all of the castles food supplies.

Charge 7) Arson-Ser Gregor burnt the Castle Stoney Hedge along with it’s unharvested crops.

Charge 8) Vandalism-We seek to charge Ser Gregor with vandalism for the above acts as well.

Charge 9) Kidnapping-While this charge may seem to be a reach, this court argues that the forceful taking of Lady Arya Stark of Winterfell should be deemed as kidnapping in the eyes of judges in this court. Ser Gregor was not aware of Lady Arya Stark, but the act of taking her against her will should not be dismissed.

Charge 10) Treason-Ser Gregor openly attacked men ordered by the Hand of the King Lord Eddar Stark of Winterfell and carrying the banner of King Robert Baratheon when they sort to bring him in to answer for his many atrocities. This attack was no different from an attack on the king himself.

Charge 11) Assault (against Kingsmen)-For the act of resisting arrest this court finds that Ser Gregor’s actions warrant a charge of assault.

**This court submit into evidence the trial of Lord Tywin Lannister, a man convicted for his involvement in the many crimes carried out by Ser Gregor Clegane.

Ser Gregor of House Clegane is a man with a violent reputation. He is eight feet tall and has committed numerous rapes and acts of violence. He has destroyed homes, crops and raided food supplies. He has no remorse, no conscience no since of his own humanity.

With that being said and looking at the facts, Ser Gregor is nothing more than a hitman for his boss Lord Tywin Lannister. Tywin has given him the resources to committ the attrocities. But he is not here and he is not on trial.

My judgment based on the facts presented by witnesses in the books, "Game of Thrones, Clash of Kings and Storm of Swords."

Count 1 - Guilty, penalty Death by Fire . . . .

Count 2- Guilty, penalty Death by Fire . .

Count 3- Guilty, penalty Death by Fire

Count 4- Not Guilty, there is no slavery, they were captives of war and were allowed the treatment of war captives. They also were not sold into slavery to the traders who visit Westeros from time to time.

Count 5- Guilty, penalty Death by Fire

Count 6- Guilty, penalty forfeiture of lands, wealth and title.

County 7- Guilty, penalty forfeiture of lands, wealth and title.

Count 8- Guilty, penalty forfeiture of lands, wealth and title.

Count 9 - Not Guilty, did not know who she was, and took her as a prison, he did not sexual assult her nor was she tortured.

Count 10- Guilty, penalty death by fire.

Count 11- Guilty, penalty death by fire.

Roast him!!!! The Night is Dark and Full of Bammers . . .

1. Guilt in respect of the first is probable, but not proved beyond reasonable doubt. Therefore Not Guilty. Guilty of the second.

2. Guilty. Albeit, he was acting under orders, but it is well-established that superior orders cannot be a defence to a charge of genocide.

3. Not Guilty (I don't recall this one.) I've now checked and yes, Lord Bracken did tell Jaime that Ser Gregor did rape his daughter. Although it's only one man's word, there is ample evidence that Ser Gregor is a serial rapist, (Princess Elia, Pretty Pia, the unnamed Innkeeper's daughter) and this can be admitted as evidence of a propensity to commit rape. So, I change my verdict to Guilty.

4. Guilty. The captives were not combatants, so cannot be regarded as prisoners of war.

9. Guilty. Ignorance of the victim's identity is no defence to a charge of kidnap.

10. and 11. Not Guilty. Ser Gregor was bound to fight on behalf of Lord Tywin, his overlord. But, that does not exonerate him from being condemned for the atrocities that he committed on behalf of Lord Tywin.

It is the sentence of this Court that the false knight, Ser Gregor, of House Clegane, be and is hereby attainted, is stripped of his land and title, is gelded, and is to be burnt until dead.

Charge 1) 2 Counts of murder-During a competitive joust Ser Gregor intentionally and successfully sort to cause fatal injury to Ser Hugh of the Vale. Ser Clegane upon invading the Riverlands successfully attacked castle Darry, killing 8 year old Lord Lyman Darry.

First case is impossible to prove. Mortal accidents are known to happen upon jousting, even though unprovoked attack with deadly force on Ser Loras Tyrrell should be taken into account as proof of the lability of Accused and his anger management issues.

Second case, guilty. Death by sword.

Charge 2) Genocide-Ser Gregor Clegane committed unwarranted acts of genocide against the people of the Riverlands.

These acts, horible though they are, are covered by Medieval Ground Combat Laws as pillaging and denying hostile party resources of the land. HOWEVER this applies only once the war was declared. Prior to death of Robert Baratheon and the beginning of the so called War of Five Kings, this was a criminal act and breach of King's Peace.

Accused is stripped of his lands and titles and put to death by sword, unless he decides to give testimony against his liege lord in this sissue - in such case just stripping of lands and titles and Black.

In the same vein, he should be prosecuted for war crimes for actions that went above and beyond basic military needs.Applies to points 4, 6 and 8 as well. If found guilty, punishment should be (given the scale of accusations) stripping of land and titles and death by hanging.

Charge 3) Rape-Upon sacking Stony Hedge the seat of House Bracken, Ser Gregor Clegane sexually assaulted and raped one of Lord Jonos Bracken daughters.

Guilty. Castration or Wall.

Charge 4) Slavery-Many survivors of Ser Cleganes’ attacks throughout the Riverlands were taken to Harrenhal Castle, where they forced into labor and abused directly by his command and Ser Clegane himself.

While the prisoners were not bought, they were effectively enslaved. Accused is to be stripped of lands and titles and sent to the Wall.

Charge 5) Torture-Ser Clegane stood by while ‘Tickler’ carried out acts of torture at his command. According to witness Chiswyck "Tickler makes them howl so hard they piss themselves..."

Position on torture is unclear, but this was clearly done outside the judiciary system, on civillians. Stripped of lands and titles, Wall.

Charge 6) Theft-Upon sacking the many castles of the Riverlands Ser Gregor stole all of the castles food supplies.

Pillaging and provisioning is covered by Medieval Ground Combat Laws. Dismissed.

Charge 7) Arson-Ser Gregor burnt the Castle Stoney Hedge along with it’s unharvested crops.

Same as 6.

Charge 8) Vandalism-We seek to charge Ser Gregor with vandalism for the above acts as well.

As 6.

However, for points 5, 6 and 7 the cases were brought in really generic terms. The accused may be charged on specific cases of doing these act above and beyond military needs.

Charge 9) Kidnapping-While this charge may seem to be a reach, this court argues that the forceful taking of Lady Arya Stark of Winterfell should be deemed as kidnapping in the eyes of judges in this court. Ser Gregor was not aware of Lady Arya Stark, but the act of taking her against her will should not be dismissed.

Either or. Because the accused was not aware of holding a highborn lady against her will, this charge jhas to be expanded to all prisoners at Harrenhall (except Prisoners of War) or none.

All in all simple fact of moving prisoners should not constitute kidnapping. Not Guilty.

Charge 10) Treason-Ser Gregor openly attacked men ordered by the Hand of the King Lord Eddar Stark of Winterfell and carrying the banner of King Robert Baratheon when they sort to bring him in to answer for his many atrocities. This attack was no different from an attack on the king himself.

Charge 11) Assault (against Kingsmen)-For the act of resisting arrest this court finds that Ser Gregor’s actions warrant a charge of assault.

Guilty on both charges. Charge no. 10 is more severe, the accused is to be stripped of lands and titles and hung by his neck until death.

Charge 1) The state does not meet the burden of proof on the intentionality or premeditation of the deaths of Ser Gregor's joust opponents. Jousting is a violent sport, where death is always a possibility. Not guilty.

Charge 2) Genocide? Not even close. Might want to rename the charge. Dismissed as a chrage.

Charge 3) Rape. Guilty. He owes monetary recompense to House Bracken.

Charge 4) Slavery. Not guilty. The use of POWs for labor is not out-of-the-question.

Charge 5) Torture. The need to extract information of one's enemies is not a crime. Dismissed as a charge.

Charge 6) Theft - Removal of supplies via sacking is not a crime. War is war. Dismissed as a charge.

Charge 7) Arson. He's not going to gain monetarily via insurance claims or whatever. Not arson. Dismissed as a charge.

Charge 8) War is not vandalism. Dismissed as a charge.

Charge 9) 1- He did not know Arya. 2 - His liege lord and her house were at war. Dismissed as a charge.

Charge 10) Dondarrion and his band lost legitimacy after the ascendance of King Joffrey I and the appointment of Tywin Lannister as Hand of the King. Not guilty.

Charge 11) See above. Not guilty.

Verdict: Ser Gregor Clegane is ordered to monetarily recompense House Bracken for the rape of one of its virgin daughters.

I find Gregor Clegane guilty of all charges brought against him. While many of his crimes were committed during a time of war and under orders, Gregor used excessive force and engaged in extreme acts of cruelty. While his crimes against humanity should be punished by flaying, I"m taking the high road on this one and recommending death by fire. Burn him.

1. Regarding ser Hugh of the Vale it cannot be proved that he intentionally killed him. Dismissed

Regarding Lord Darry it was during the war. Innocent

2. Under orders from his Lord to wreak havoc to their enemies and assist the war effort. Innocent

10. War had not been declared. While at that point he was guilty later a new king ascended the throne, the Hand was executed and the orders were invalid. Dismissed

While there are many reports of his brutal nature all of the above happened because his Lord ordered him and took place during the reign of the former king.

Not Guilty on the 1st, "competitive joust" being the operative phrase.

Guilty on the 2nd. Take his head.

Charge 2) Genocide-Ser Gregor Clegane committed unwarranted acts of genocide against the people of the Riverlands.

Not guilty. The conditions for genocide are not met. The smallfolk of the riverlands were collateral damage in a scorched earth tactic employed by Tywin Lannister. A dishonourable tactic maybe, but is is in "The Art of War" so you tell Sun Tzu.

Charge 3) Rape-Upon sacking Stony Hedge the seat of House Bracken, Ser Gregor Clegane sexually assaulted and raped one of Lord Jonos Bracken daughters.

Guilty. Balls or the wall.

Charge 4) Slavery-Many survivors of Ser Cleganes’ attacks throughout the Riverlands were taken to Harrenhal Castle, where they forced into labor and abused directly by his command and Ser Clegane himself.

Charge 7) Arson-Ser Gregor burnt the Castle Stoney Hedge along with it’s unharvested crops.

Not guilty. See 2nd charge.

Charge 8) Vandalism-We seek to charge Ser Gregor with vandalism for the above acts as well.

Not guilty.

Charge 9) Kidnapping-While this charge may seem to be a reach, this court argues that the forceful taking of Lady Arya Stark of Winterfell should be deemed as kidnapping in the eyes of judges in this court. Ser Gregor was not aware of Lady Arya Stark, but the act of taking her against her will should not be dismissed.

Not guilty. Lady Arya is only protected if she makes herself known. She is covered in rthe slavery charge anyway.

Charge 10) Treason-Ser Gregor openly attacked men ordered by the Hand of the King Lord Eddar Stark of Winterfell and carrying the banner of King Robert Baratheon when they sort to bring him in to answer for his many atrocities. This attack was no different from an attack on the king himself.

Guilty. Bring me a block...

Charge 11) Assault (against Kingsmen)-For the act of resisting arrest this court finds that Ser Gregor’s actions warrant a charge of assault.

I find the defendant, Ser Gregor of House Clegane, guilty of all charges but the fourth. I hereby sentence him to death by hanging. The use of very strong rope is advised.
