So yeah the theory is pretty obviously well known by now, but something got me on the TV show which *Spoilers ahead* they were all "Jon is the rightful king"

Ignoring right of conquest which gave it to the baratheons in the first place im wondering if the timeline fits for Jon to be the "rightful heir" as it were.

So im a little vague on the timeline but leading up the the battle of the trident Rhaegar has, some kids, a brother (Viserys) and sister (Hail Mysha!) and is the crown prince.

So Rhaegar gets hammered at the trident, RIP Rhaegar, and all eyes on the new crown price Rhaegars son (or his daughter depending on age).

Somewhat after the trident, King's landing is invaded. bye bye mad king, and ignoring griff for now as noone knows anything about him, bye bye rhaegars kids.

Ned rocks up to kings landing all broody at Jamie and the dead babies. and off he trots to the tower of joy with his posse.

So at this point to the world at large. There are 2 Targaerians left, Vis and Danny

Now who does this leave as the rightful heir but ole sister loving Viserys.

So Ned, Froggy and cannon fodder arrive at the tower of joy in northern Dorne, from kindslanding thats a trek right the way through the Stormlands and TV teleportation aside, it is more than a 15s montage of guy on a horse.

Jon is born somewhere around this time. As there don't seem to be any rumours of any kingsguard off buying formula, its quite likely this is very close timewise to Ned arriving just in time to hear a whisper and watch Lyanna go, RIP Lyanna

 

So getting to my point of this rant. Hail king Jon?

How does an as yet unborn descendant(at the time of the mad king dying) fit into the order? assuming many weeks had passed surely Viserys would be king (if robert had given up and not claimed it)

 

Once Viserys dies, great scene, who is next in line to him. Does it go back to his older brother's son. or would it go to his sister? Then her descendants and then her siblings descendants?

 

Any real life examples of this happening would be nice. Where rightful heirs are born shortly after someone else claims the throne based on their lack of timely birth.

Aerys disowned Rhaegar and made Viserys his heir too, don't forget, so at that point Rhaegar's kids would be out of the running, legitimate or not.  Viserys was the next king from that point of view.  But with Viserys gone, Jon, if legitimate, comes back in line because the government in Westeros eons ago decreed no females could take the Iron Throne.

Historically, there have been kings born after their fathers died - one of the Henrys even I think - but in each case the acknowledged queen was known to be expecting, and a regency was declared.

Assuming that R&L were married and Jon is legitimate, Jon would be heir under the normal rules of succession because the eldest son of the eldest son comes before the younger brother of the eldest son. Ie, Prince Harry is behind little prince George and Princess Charlotte, not directly behind his older brother, William.

With Rhaegar being disinherited, however, we would have had all the makings of a good old-fashioned civil war as both Jon and Vis could lay claim to the IT.
