Lysa allowed herself to be manipulated by Tyrion into allowing him to demand a trial and then trial by combat, infront of the court. Then Tyrion won, and Lysa had no choice but to free him. Catelyn was against the whole thing. Also, it didn't seal Ned's fate... He was going to be sent to the Wall before Joffrey decided to make him a head shorter. Joffrey sealed Ned's fate. It is one of the challenges of reading a big story that involves waiting 5 -10 years between installments because only GRRM knows where this is all going. Or at least the big stuff but, you know, he is constantly planting seeds and cultivating and weeding and nurturing so I'm sure by the time A Promise of Spring is published all of the major characters will experience things that even he hasn't thought of yet.
