Official Court of Law v 11: Olenna and Margaery Tyrell

Welcome to the 11th installation of the “Official court of law” for this board. In this thread we will debate and pass judgement on character crimes from the work ASOIAF. As judges we bear a burden of upholding the integrity of our court so being impartial is imperative, keep all arguments in a legal context that suit the standards of this court. All posters are welcomed to make their case, at the end of your argument pass your judgement and sentence!!!!

The President of the Court, Lion of Judah, has been summoned to other duties, and I shall be taking his place pro-tem.

The rules: Every poster has one vote (per charge) of guilt or innocence.

**For a guilty verdict, your options are:

Send them to the wall. (same as a life prison sentence)

Death by sword. (Clean and quick)

Death by hanging (Not so clean and quick).

Monetary fine

Exile

Stripped of land/title.

Prison sentence

Community Service

NB. Following representations by numerous distinguished jurists, Death by burning alive will no longer be available as a sentence. However, Death by hanging is now an option, as is community service (the judge should state what form of community service he/she considers appropriate).

**If you find the character innocent, simply state innocent or Not Guilty after your argument.

As for as evidence that can be submitted, posters can submit any argument they deem relevant. However we cannot use any pardons (save in one instance) or prior convictions as evidence in the matter. Our court will not recognize the judgement of any other court or ruling body. In the event that a defendant is charged with an offence against another character, judges are entitled (but not obliged) to find that defendant Not Guilty, if the latter has pardoned or forgiven them.

**You can also vote for charges to be dismissed (majority rule). Any vote to dismiss charges will be treated as an acquittal, and be added to any verdicts of Not Guilty/Innocent.

**At the end of the week the vote will be counted and the final sentence carried out. Majority rules. Only the nominated character will be discussed, however, you can indict characters you also find culpable, as part of your ruling, and they can be added to the docket.

**Votes can be changed before they are counted, but do so in your original post.

Posters can just cast a vote, which is your right, but try to state a case as well. Your opinion actually matters and it may serve to change the vote of another judge.

*Do not take it personally if your favorite character is being torn to pieces. Everyone is fair game.

****If votes of 'not guilty' and 'dismissed' taken together comprise over 50% of the total votes cast, the defendant is to be found 'not guilty' or the charge is to be 'dismissed', with the option that gained the most votes between the two representing the final verdict.****

Please note that you will be expected to reach verdicts in respect of each Defendant. You may find either, or both, of the Defendants Guilty or Not Guilty.

1.Treason

Three Counts against Queen Margaery, and Two against Lady Olenna.

1.1 The Defendants jointly supported the attainted traitor Lord Renly Baratheon in his efforts to usurp the Iron Throne.

1.2 The Defendants jointly conspired with Lord Peter Baelish to murder his Grace King Joffrey Baratheon, “the noblest lad ever to wear the Crown”, which murder was carried out by the Defendants at the Feast to celebrate the wedding of Queen Margery to the King.

1.3 Queen Margaery committed treason by committing adultery with inter alia, her brother Ser Loras Tyrell, Ser Hobar and Ser Horras Redwyne, Jalabar Xho, the Blue Bard, and Hamish the Harper , while married to his Grace, King Tommen Baratheon.

2. Murder.

One count against both Defendants.

The Defendants murdered his Grace, King Joffrey Baratheon, as detailed in charge 1.2 above.

3. Perverting the Course of Justice

The Defendants jointly, and intentionally, conspired with Lord Peter Baelish, to implicate Lord Tyrion Lannister, Master of Coin, and Lady Sansa Stark of Winterfell, as being responsible for the murder of King Joffrey as aforesaid, which resulted in Lord Tyrion and Lady Sansa being wrongly attainted as traitors.

4. Obtaining Property by Deception

One Count against Lady Olenna.

Lady Olenna has routinely paid suppliers of goods and services in old gold coins that are worth half the figure that has been bargained for.

Treason:

1.1 Guilty, monetary fine to be paid to the true heir to the IT.

1.2 Guilty but with suspended sentence as Joffrey was not the legitimate heir to the IT and the act was due to the sociopath behavior of the victim.

1.3 Innocent of the charges.

Murder:

Same as above(guilty but with relieving factors.

Perverting...:

Guilty, monetary compensation to the wrongly accused.

Deception:

Guilty, monetary compensation.

1.1: I find both defendants guilty not guilty.

In light of the evidence presented by damn_999, I change my verdict to not guilty.

“It’s treason, I warned them, Robert has two sons, and Renly has an older brother, how can he possibly have any claim to that ugly iron chair? Tut-tut, says my son, don’t you want your sweetling to be queen?

1.2: I find only Lady Olenna guilty. Due to a lack if evidence, the charges against Margaery Tyrell are dismissed.

1.3: Charges dismissed.

2. Same as charge 1.2 - I find Lady Olenna guilty and dismiss the charges against Margaery Tyrell.

3. I find Lady Olenna not guilty and dismiss the charges against Margaery Tyrell.

4. Charges dismissed. This is nothing more than a rumor started by Varys.

For charge 1.1 I sentence both defendants to community service working with the Silent Sisters for six months.

For charges 1.2 and 2 some form of reward is in order since Joffrey's murder was a service to the realm.

2. Olenna is found guilty, prison sentence, Margaery not, charges to be dissmissed, due to lack of proof

3. Not guilty.

1.1 Not Guilty for both. The decision to form an alliance and later support the claim of Lord Renly Baratheon was made by Lady Olenna and Queen Margaery's Liege Lord, Mace Tyrell. Lady Olenna voiced her opposition to Lord Renly's claim. Additionally, both were subsequently pardoned for their actions by the Iron Throne.

1.2 Guilty for both. Having accepted Joffrey Baratheon as their king, both Lady Olenna and Queen Margaery took part in the plot to assassinate him.

1.3 Not Guilty. The accusations against Queen Margaery were fabricated by loyalists of Queen Cersei Lannister in attempt to ingratiate themselves with the Queen Regent.

2 Guilty for both. See 1.2

3 Not Guilty for both. While they certainly intended to use Lady Sansa Stark in the murder of Joffrey (by having her smuggle the poison into the wedding feast), there is no evidence to support the accusation that they intended to have her publicly implicated in the murder. Nor is there evidence that if they apprehend Lady Sansa that they intend to follow through with a trial. Additionally there is no firm evidence that they were aware of Petyr Baelish's attempt to implicate Tyrion in the murder.

4 Not Guilty. In the Reach, gold roses(?) are still commonly accepted as currency. If a provider of goods or services in the Reach (where these alleged crimes presumably took place) fails to specify that the price for those goods or services must be paid in gold dragons, not simply gold pieces, then it is the fault of the business owner if the customer pays with gold roses instead.

Sentence: Although both Queen Margaery and Lady Olenna are guilty of treason and murder, the sadistic nature of their victim Joffrey provides a mitigating circumstance. Their actions were undertaken for the greater good and because of that the harshest punishments are off the table.

Queen Margaery should be stripped of her title as queen. Both Lady Olenna and Lady Margaery should be exiled from Kings Landing and the Royal Court and return to Highgarden. There they will remain until Lady Olenna's death and Lady Margaery is found a suitable marriage from within the Reach.

Not guilty. Olenna expressed quite clearly reservations about supporting Renly but was overriden by Mace.

Guilty.

Sansa felt as though her heart had lodged in her throat. The Queen of Thorns was so close she could smell the old woman’s sour breath. Her gaunt thin fingers were pinching her wrist. To her other side, Margaery was listening as well. A shiver went through her. “A monster,” she whispered, so tremulously she could scarcely hear her own voice. “Joffrey is a monster. He lied about the butcher’s boy and made Father kill my wolf. When I displease him, he has the Kingsguard beat me. He’s evil and cruel, my lady, it’s so. And the queen as well.” Lady Olenna Tyrell and her granddaughter exchanged a look. “Ah,” said the old woman, “that’s a pity.”

You do look quite exquisite, child,” Lady Olenna Tyrell told Sansa when she tottered up to them in a cloth-of-gold gown that must have weighed more than she did. “The wind has been at your hair, though.” The little old woman reached up and fussed at the loose strands, tucking them back into place and straightening Sansa’s hair net.

Littlefinger laughed. “Ser Dontos the Red was a skin of wine with legs. He could never have been trusted with a task of such enormity. He would have bungled it or betrayed me. No, all Dontos had to do was lead you from the castle . . . and make certain you wore your silver hair net.” The black amethysts. “But . . . if not Dontos, who? Do you have other . . . pieces?”

Petyr smiled. “I will wager you that at some point during the evening someone told you that your hair net was crooked and straightened it for you.”

Sansa raised a hand to her mouth. “You cannot mean . . . she wanted to take me to Highgarden, to marry me to her grandson . . .”

“Gentle, pious, good-hearted Willas Tyrell. Be grateful you were spared, he would have bored you spitless. The old woman is not boring, though, I’ll grant her that. A fearsome old harridan, and not near as frail as she pretends.

1.3 Queen Margaery committed treason by committing adultery with inter alia, her brother Ser Loras Tyrell, Ser Hobar and Ser Horras Redwyne, Jalabar Xho, the Blue Bard, and Hamish the Harper , while married to his Grace, King Tommen Baratheon.

Not Guilty, unless Cersei Lannister's paranoia is admissable as evidence.

2. Murder.

One count against both Defendants.

The Defendants murdered his Grace, King Joffrey Baratheon, as detailed in charge 1.2 above.

Guilty, as per 1.2

3. Perverting the Course of Justice

The Defendants jointly, and intentionally, conspired with Lord Peter Baelish, to implicate Lord Tyrion Lannister, Master of Coin, and Lady Sansa Stark of Winterfell, as being responsible for the murder of King Joffrey as aforesaid, which resulted in Lord Tyrion and Lady Sansa being wrongly attainted as traitors.

Again, guilty, as per 1.2

One Count against Lady Olenna.

Lady Olenna has routinely paid suppliers of goods and services in old gold coins that are worth half the figure that has been bargained for.

Not guilty. Cersei makes this claim;

Cersei sat beneath the window. “Did you know that the Queen of Thorns keeps a chest of coins in her wheelhouse? Old gold from before the Conquest. Should any tradesman be so unwise as to name a price in golden coins, she pays him with hands from Highgarden, each half the weight of one of our dragons. What merchant would dare complain of being cheated by Mace Tyrell’s lady mother?

However, the claim is made based upon the Garderner coin Qyburn finds in Ruben's cell. Given Ruben was one of Varys persona's, it's assured that Varys planted the coin there to implicate the Tyrells and sow discord between them and the Lannisters, making it impossible to discern whether Olenna is actually guilty of shortchanging merchants.

Sentence:

Strip Olenna and Margaery of titles, and set them to a lifetime prison sentence.

1.2 The Defendants jointly conspired with Lord Peter Baelish to murder his Grace King Joffrey Baratheon, “the noblest lad ever to wear the Crown”, which murder was carried out by the Defendants at the Feast to celebrate the wedding of Queen Margery to the King.

Guilty for Lady Olenna, NOT guilty for Margaery.

1.3 Queen Margaery committed treason by committing adultery with inter alia, her brother Ser Loras Tyrell, Ser Hobar and Ser Horras Redwyne, Jalabar Xho, the Blue Bard, and Hamish the Harper , while married to his Grace, King Tommen Baratheon.

Not guilty due to weak evidence.

2. Murder.

One count against both Defendants.

The Defendants murdered his Grace, King Joffrey Baratheon, as detailed in charge 1.2 above.

Guilty for Lady Olenna, NOT guilty for Margaery.

3. Perverting the Course of Justice

The Defendants jointly, and intentionally, conspired with Lord Peter Baelish, to implicate Lord Tyrion Lannister, Master of Coin, and Lady Sansa Stark of Winterfell, as being responsible for the murder of King Joffrey as aforesaid, which resulted in Lord Tyrion and Lady Sansa being wrongly attainted as traitors.

Guilty.

4. Obtaining Property by Deception

One Count against Lady Olenna.

Sentence: Lady Olenna: Death by sword :frown5: 2- A fine for compensation for the suppliers

OP just a suggestion for future treads - i see that you have listed the punishments by their severity but in medieval society being striped of lands is by far much harsher punishment than being beheaded - one affects the person the other the entire family and generations to come.

1.1 Mace Tyrell decided to support Renly Baratheon. Whether the Defendants supported his decision or not he is the Lord of House Tyrell. Innocent

1.2 Guilty for Lady Olenna, death by sword. No evidence against Margaery

1.3 Only one person admitted having having sex with Margaery and did not change his testimony. But Margaery did ask from GM Pycelle for Moon Tea. Innocent because of weak evidence.

2 Guilty for Lady Olenna, death by sword. No evidence against Margaery

3 Innocent. No evidence. It was Cersei that accused Tyrion and Sansa for the murder

4 Guilty. Monetary fine

My decisions on these charges are:

1.1. Both accused, not guilty. The defendants were obeying their liege lord Mace Tyrell. In a feudal system they are obliged to do so.

1.2. Margaery is not guilty. There is no evidence that she conspired against her betrothed. Olenna is guilty of some sort of conspiracy by giving a poisoned hair net to Sansa, but there is no proof that she conspired with Litttlefinger (Peter Baelish), except Littlefinger's word. In light of the past behavior of Joffrey "Baratheon", I feel that Olenna was justifiably worried about the life and health of her granddaughter Margaery . In light of this mitigating circumstance I sentence Olenna to six months house arrest.

1.3. Not Guilty. There is not a shred of evidence to support these accusations. It appears that the charges are in imitation of the charges against Anne Boleyn, perhaps inspired by the fact that Natalie Dormer plays Margaery in Game of Thrones and also played Anne Boleyn in The Tudors. The President (Pro-tem) of this court appears to be playing a prank on his fellow court members here.

2. Not guilty. There is no evidence that either of the defendants carried out the poisoning of Joffrey, except the word of Littlefinger.

3. Not guilty. The word of Littlefinger is again the only evidence and cannot be verified.

4. Not guilty. Varys asserts this claim, but has not proven it.

Overall sentence is six months house arrest for Olenna.

PS: The President (Pro-tem) of this court shows evidence of bias, or has a misplaced sense of humor, when he describes Joffrey as the noblest lad ever to wear the Crown”. If the President Pro-tem expects his fellow judges to be impartial he should also avoid the appearance of bias.

It was Mace Tyrell's decision, plus Olenna expressed disagreement. Charges dissmissed for both.

Margaery: There is no evidence that she had a part. Unless she is a very talented actress, her reaction persuaded me that she was ignorant of Olenna's plan. She was like "I'm cursed, second time married and still not bedded" and her mother telling her "it's not your fault". Also, when Littlefinger talks about Joffrey's murder with Sansa, he doesn't implicate Margaery either.

Olenna: Guilty for murder, but given that Joffrey is not the rightful king, it is not treason. Charges dissmissed for both.

1.3 Queen Margaery committed treason by committing adultery with inter alia, her brother Ser Loras Tyrell, Ser Hobar and Ser Horras Redwyne, Jalabar Xho, the Blue Bard, and Hamish the Harper , while married to his Grace, King Tommen Baratheon.

This is all Cersei's false accusations. Shouldn't even be in the indictment. Charges dissmissed.

2. Murder.

The Defendants murdered his Grace, King Joffrey Baratheon, as detailed in charge 1.2 above.

As in 1.2, Charges dissmissed for Margaery. Olenna is guilty.

3. Perverting the Course of Justice

The Defendants jointly, and intentionally, conspired with Lord Peter Baelish, to implicate Lord Tyrion Lannister, Master of Coin, and Lady Sansa Stark of Winterfell, as being responsible for the murder of King Joffrey as aforesaid, which resulted in Lord Tyrion and Lady Sansa being wrongly attainted as traitors.

Charges dissmissed for Margaery. There is no conclusive evidence that Olenna had a part in this. Cersei proclaimed Tyrion guilty, based on "evidence" constructed by Littlefinger. Charges dissmissed for Olenna, based on doubt.

4. Obtaining Property by Deception

Lady Olenna has routinely paid suppliers of goods and services in old gold coins that are worth half the figure that has been bargained for.

Is this a joke? Lady Catelyn had much more seemingly convincing evedence to accuse Tyrion for the assassination attempt against Bran, and yet she was accused by this very court for kiddnapping him without a reason... Charges dissmissed.

Lady Olenna Tyrell is found guilty for murder and normally she should be condemned to death by sword. Due to her very old age and to the fact that she acted in order to protect her beloved grandaughter from a sadist, that her oaf son had arranged for her to marry, she is to spend the rest of her life with the Silent Sisters.

Margaery is innocent.

1.1 Not Guilty. Renly took his oldest brother's example: he intended to take the throne by force, a method that has proven to work. And as Cersei says to Joffrey: When you sit the throne, the truth is what you make it (or something along those lines).

The Tyrell's supported the king their liege had chosen, they had no saying in this matter.

1.2 Not Guilty. Littlefinger has proved to not be a reliable source. Anything he accuses them of can not be held against them. So not guilty until proven otherwise.

1.3 Not Guilty until proven otherwise.

2. Murder.

Not Guilty see 1.2

3. Perverting the Course of Justice

Not Guilty. See 1.2. We only have Litterfinger's word on their involvement in the matter, which is not reliable. If they were not involved in the matter (not guilty until proven otherwise) they could not have known about Tyrion and Sansa's innocence in the matter.

4. Obtaining Property by Deception

Not Guilty. The suppliers could have known this if they had paid more attention. Lady Olenna only took advantage of their stupidity, which is not illegal in my book.

Defendants are not Guilty on all accounts, no punishment required.

Not guilty. As others have said, this was the decision of Mace Tyrell not Queen Margaery or Lady Olenna. ETA: Charges to be dismissed, as Joffrey previously pardoned all Tyrells for their previous associations.

The Defendants murdered his Grace, King Joffrey Baratheon, as detailed in charge 1.2 above.

3. Perverting the Course of Justice

The Defendants jointly, and intentionally, conspired with Lord Peter Baelish, to implicate Lord Tyrion Lannister, Master of Coin, and Lady Sansa Stark of Winterfell, as being responsible for the murder of King Joffrey as aforesaid, which resulted in Lord Tyrion and Lady Sansa being wrongly attainted as traitors.

Not guilty. While there is evidence to implicate Lady Olenna in the murder of King Joffrey, there seems to be no evidence that she was involved in the cover-up to implicate Lord Tyrion. Queen Cersei brought the charges and Tyrion's behavior at the wedding feast could not be foretold. As there is no evidence to implicate Margaery in the murder of Joffrey, there is no evidence to implicate her in the cover up.

4. Obtaining Property by Deception

One Count against Lady Olenna.

Lady Olenna has routinely paid suppliers of goods and services in old gold coins that are worth half the figure that has been bargained for.

Not guilty, it is likely the evidence was planted by Lord Varys to provoke Queen Cersei.

Sentencing:

Margaery is not guilty on all counts.

Lady Olenna to serve the remainder of her natural life in prison at Highgarden.

Three Counts against Queen Margaery, and Two against Lady Olenna.

1.1 The Defendants jointly supported the attainted traitor Lord Renly Baratheon in his efforts to usurp the Iron Throne. - Not Guilty. A Pardon was given by the King on the Iron Throne. And by my own and British standards supporting the losing side in a civil war is not a crime.

1.2 The Defendants jointly conspired with Lord Peter Baelish to murder his Grace King Joffrey Baratheon, “the noblest lad ever to wear the Crown”, which murder was carried out by the Defendants at the Feast to celebrate the wedding of Queen Margery to the King. - Not Guilty. Need to wait until the dust has settled and the civil war ended until it can be put down as treason.

The Defendants murdered his Grace, King Joffrey Baratheon, as detailed in charge 1.2 above. - Inconclusive, this could be argued as a case of self defense for Margaery due to the King's reputation and known actions. I'll put this down as guilty of Culpable Homicide

3. Perverting the Course of Justice

The Defendants jointly, and intentionally, conspired with Lord Peter Baelish, to implicate Lord Tyrion Lannister, Master of Coin, and Lady Sansa Stark of Winterfell, as being responsible for the murder of King Joffrey as aforesaid, which resulted in Lord Tyrion and Lady Sansa being wrongly attainted as traitors. - Not Guilty. No direct moves were taken by the Defendants to draw attention or pin the blame on Lord Tyrion and Lady Sansa, the court came to that conclusion by itself.

4. Obtaining Property by Deception

One Count against Lady Olenna.

Lady Olenna has routinely paid suppliers of goods and services in old gold coins that are worth half the figure that has been bargained for. Not guilty on grounds of insubstantial evidence.

Punishment: Should be a bloody medal but I'll go with Life long House Arrest for the Queen of Thorns and a payment of blood money to the family of Joffrey Baratheon in the amount of 100,000 gold dragons

OP just a suggestion for future treads - i see that you have listed the punishments by their severity but in medieval society being striped of lands is by far much harsher punishment than being beheaded - one affects the person the other the entire family and generations to come.

However, forfeiture of lands/title can be reversed at a future date.

Death is quite final.

PS: The President (Pro-tem) of this court shows evidence of bias, or has a misplaced sense of humor, when he describes Joffrey as the noblest lad ever to wear the Crown”. If the President Pro-tem expects his fellow judges to be impartial he should also avoid the appearance of bias.

I should have made clear that that was the opinion of Grand Maester Pycelle. As the Court sits in Old Town, the President of the Court is obliged to treat his opinions with outward respect.

Regarding charge 3, we most definitely have Sansa's point of view, when she has fled from the wedding feast, and realises in horror what she has been wearing on her head, and the appalling predicament that has placed her in. It's not just LF's word.

Of course, it is entirely a matter for you to determine whether or not the gift of the hairnet to Sansa (and the use to which it was put) was intended to implicate her as being responsible for Joffrey's death.

Of course, it is entirely a matter for you to determine whether or not the gift of the hairnet to Sansa (and the use to which it was put) was intended to implicate her as being responsible for Joffrey's death.

Yeah, I don't see that as trying to make Sansa look guilty, it just seems like a way to smuggle in the poison easily. Littlefinger may have wanted Sansa to feel guilty so she'd easily flee the city with him, but I don't see the Tyrells having any part in those motivations.
