Official Court of Law v 11: Olenna and Margaery Tyrell

Yeah, I don't see that as trying to make Sansa look guilty, it just seems like a way to smuggle in the poison easily. Littlefinger may have wanted Sansa to feel guilty so she'd easily flee the city with him, but I don't see the Tyrells having any part in those motivations.

1.Treason

Three Counts against Queen Margaery, and Two against Lady Olenna.

1.1 The Defendants jointly supported the attainted traitor Lord Renly Baratheon in his efforts to usurp the Iron Throne.

1.2 The Defendants jointly conspired with Lord Peter Baelish to murder his Grace King Joffrey Baratheon, “the noblest lad ever to wear the Crown”, which murder was carried out by the Defendants at the Feast to celebrate the wedding of Queen Margery to the King.

1.3 Queen Margaery committed treason by committing adultery with inter alia, her brother Ser Loras Tyrell, Ser Hobar and Ser Horras Redwyne, Jalabar Xho, the Blue Bard, and Hamish the Harper , while married to his Grace, King Tommen Baratheon.

2. Murder.

One count against both Defendants.

The Defendants murdered his Grace, King Joffrey Baratheon, as detailed in charge 1.2 above.

3. Perverting the Course of Justice

The Defendants jointly, and intentionally, conspired with Lord Peter Baelish, to implicate Lord Tyrion Lannister, Master of Coin, and Lady Sansa Stark of Winterfell, as being responsible for the murder of King Joffrey as aforesaid, which resulted in Lord Tyrion and Lady Sansa being wrongly attainted as traitors.

4. Obtaining Property by Deception

One Count against Lady Olenna.

Lady Olenna has routinely paid suppliers of goods and services in old gold coins that are worth half the figure that has been bargained for.

1.1: Not Guilty. Mace Tyrell made the decision of backing Renly.

1.2: Not Guilty. The Crown does not hold any proof of Marge or Olenna's wrongdoing, therefore, not guilty.

1.3: Not Guilty. The only willing witness to this treason later confirmed falsifying his testimony under the orders of Queen Regent Cersei Lannister.

2. Not Guilty. The Crown does not hold any concrete proof of the Tyrell's attempt on King Joffrey's life.

3. Not Guilty. See charge number 2. The Court does not hold any evidence of the Tyrells or even brave Lord Baelish's plot to frame Lord Tyrion Lannister and Lady Sansa Stark.

4. Dismissed. The whole affair could have been caused by a misunderstanding, the Tyrell household will be obligated to reimburse the suppliers though.

Verdict: Not Guilty, the Crown finds them the very definition of innocent.

1. The firs count of treason is non applicable because the Tyrell's were already forgiven for taking up arms against the Iron Throne and welcomed back into the Kings peace. The other charges in this category are also based on shaky circumstantial evidence, the word of Littlefinger and the false testimony that was fabricated by Cersei. Therefore move to dismiss

2. The second charge of murder is likewise based upon the word of Littlefinger, a man whose words have proven to be treacherous. It is unkown how far his involvement goes into this even, so I move to combine this charge with all existing offenders at a later date.

3. Without the full knowledge of the events in question I would recommend that further investigation is required, into the Tyrells and the Lannister involvement (Cersei and Tywin). If there is no further investigation then dismiss.

4. Again, the word of Littlefinger and no list of her financial fraud. At the most right now a monetary fine.

1.1. The whole kingdom was at war. Joffery wasn't the true king, but they didn't know Stannis was. Add to that, the chaos of the war, it's hard to declare anyone but those who declare themselves king responsible for the treason. GUILTY BUT PARDONED

1.2. They accepted Joffery as their king. They swore loyalty to him. GUILTY

1.3. INNOCENT

2. They were in on it regardless of who was the actual poisoner. Margery's fear is not a valid reason. They could have convinced their father to simply not let Loras join the Kingsguard. They could have refused. Hell, they could have arranged the marriage with Tommen in the first place since Joffery was still engaged at that point. I suspect that her fear was only a part of it. Giving the Tyrells access to the more malleable Tommen was likely just as big of a reason. GUILTY

3. GUILTY

4. GUILTY

Punishment: Payment double of agreed to price in defrauded parties in charge 4 and execution for the murder charges. Possibly show Margery leniency if it is shown that she had little knowledge of the assassination attempt or was more motivated by fear of him (in which case her punishment shall be prison in the form of being a hostage to a trustworthy and neutral party agreed with by both House Lannister and Tyrell [the Church of the Seven if an agreement cannot be found]).

EDIT: Almost forgot charge three. Suitable restitution should be made to Tyrion Lannister and Sansa Stark.

EDIT 2: To clarify, the death is by sword.

1.1 Not guilty: already pardoned by the king, and olenna didn't want to support renly too

1.2 dismissed: No solid evidence of their involvement only hints passed in conversation by LF,

1.3 Dismissed: little solid evidence from dubious prosecution

2: dismissed for same reason as above

3: not guilty: No evidence is present that tyrion was actually framed, rather than cersei just accusing him out of hatred

4: guilty:

verdict: monetary fine + community service for coin fixing to lady olenna, Margaery tyrell: innocent

First Defendant (Olenna Tyrell nee Redwyne)

1.1 Supporting Renly Baratheon

Guilty on a strict liability basis. In line with previous judgements on this point, given the technical guilt but lack of serious wrongdoing and contradictory legal precedent, a nominal monetary fine is imposed of one copper star.

1.2 Murder of Joffrey Baratheon

The guilt of the defendant in this matter has not been proven beyond reasonable doubt. Not guilty. Moreover, this judge is minded to consider that, Joffrey Baratheon being a disgrace to the title of king, a charge of treason in this instance, even were guilt of the crime to be proven, would not be in the public interest and would consider dismissing charges on those grounds. In the absence of conclusive evidence, the not guilty verdict should stand.

2. Murder of Joffrey Baratheon

As outlined above, despite the testimony of Lord Baelish, a known perjurer, and circumstantial evidence rendered by Sansa Stark, I do not consider there to be sufficient evidence to put this matter beyond reasonable doubt. Not guilty.

3. Perverting the course of justice

This judge does not find that sufficient evidence has been presented to suggest that Olenna Tyrell at any point accused Tyrion Lannister ot Sansa Stark of the crime. Her words at the time instead were indicative of accident. Tyrion Lannister was accused and prosecuted by Cersei Lannister and Olenna Tyrell did not give evidence during the trial. Not guilty.

4. Obtaining property by deception

By a strict construction of the terms of the agreement, Olenna Tyrell was entitled to the property she so obtained. On the grounds of equity, this judge is prepared to consider rescission of any contracts so agreed on a case-by-case basis, subject to action being brought and information disclosed by the relevant parties. For the purposes of this charge, not guilty.

Second Defendant: Margaery Tyrell

1.1 Supporting Renly Baratheon

On the same grounds as for Olenna Tyrell, Margaery is found guilty on a strict liability basis. However, this judge is minded to consider the mitigating factor of coercion, and that Margaery was on the balance of probabilities forced into supporting Lord Renly. With that mitigation in mind, sentence is waived.

1.2 Murder of Joffrey Baratheon

The evidence connecting Margaery Tyrell to the crime is less substantial than that connecting Olenna Tyrell to the murder and certainly not enough to put the matter beyond reasonable doubt. Not guilty.

1.3 Adultery

Not guilty on the basis of no case to answer. Insufficient evidence has been presented to suggest that any crime has been committed, and that evidence which has been provided is variously inadmissible or so unreliable as to render any guilty verdict derived from it unsafe.

3. Perverting the course of justice

Not guilty on broadly the same grounds as the First Defendant. At no time is it recorded that the Second Defendant made any statement on the subject of Tyrion Lannister's connection with King Joffrey's death.

Overall verdict and sentence:

Olenna Tyrell: Guilty on the first charge of treason. Consistent with previous judgements on this point, a nominal monetary fine is imposed. Not guilty on all other charges.

Margaery Tyrell: Guilty on the first charge of treason. Taking mitigating factors into account, sentence is waived. Not guilty on all other counts.

PS what was the verdict for the stannis trial? It seemed as if the thread just got locked without any result being declared

The thread was restarted to confirm the verdict. He got a monetary fine.

1.Treason

1.1 The Defendants jointly supported the attainted traitor Lord Renly Baratheon in his efforts to usurp the Iron Throne.

GUILTY. The members of House Tyrell who supprted Renly were not supporting the true heir of King Robert of House Baratheon.

They then, despite having opportunity to bend the knee along with many of their bannermen, continued to persist in their infamy by supporting another two false contenders after the Renly's death (Joffrey and Tommen, who are named "Baratheon" but look so very Lannister).

NOT GUILTY. The charge cannot be treason, as Joffrey was a bastard born of incest between the Kingslayer, Ser Jaime Lannister, and his sister, Queen Cersei Lannister. He is therefore not a king, and therefore it is not treason. The matter goes likewise with regard to Tommen, whom they support the claim of, and also Myrcella who makes no claim to the throne that the court is aware of.

NOT GUILTY. There is simply no reliable evidence against Margaery Tyrell with regard to adultery. The accustions made by Ser Osney Kettleblack are full of reasonable doubt, as his confession of carnal relations with her were then compounded with inconsistencies and even more accusations when he was questioned sharply by the High Septon. He is not a credible witness in this matter. The "Blue Bard" has been tortured to the point where he has lost his mind, so he cannot be independently questioned now, and the court has doubts about his veracity as well, given that Qyburn may have induced him to false confession through a combination of pain and leading questions. After all, Qyburn was stripped of his maester's chain by the Citadel, when they found fault with his methods.

Grandmaester Pycelle, who seems to be the chief witness of the prosecution, attested that he provided "moon tea", the implcation being that this was to abort the product of Margaery's supposed fornications. The provision of moon tea to a person does not stand as proof that the one receiving it is the one drinking it. It could be anyone in Lady Margaery's household or retinue. The court has no ability to gain further testimony from him, as he is now dead. For that matter, Grandmaster Pycelle is not a man of spotless reputation either, for the court has learned he abetted the Sack of King's Landing, and he was once confined to the Black Cells by Tyrion Lannister though later released and reinstated to office.

As such, there is no clear confirmation of Margaery Tyrell having carnal relations with anyone named, which would be necessary for a guilty verdict to be rendered here.

2. Murder.

The Defendants murdered his Grace, King Joffrey Baratheon, as detailed in charge 1.2 above.

On this count, the court finds Lady Olenna Tyrell GUILTY.

On this count, the court finds Lady Margaery Tyrell NOT GUILTY.

No evidence has been offered that Margaery was involved in the plot to murder Joffrey. Conjecture and rumour, yes. Motive and perhaps some personal gain, yes. But there does not seem to be material evidence that she had any part in planning or carrying it out.

NOT GUILTY. The order to arrest Tyrion and Sansa Lannister Stark was given by Cersei Lannister, in front of dozens of witnesses. Neither defendant had accused Tyrion Lannister, nor is their evidence that it was their intent he be blamed for it.

(As well, the issue of whether justice was or was not perverted is a matter for debate, given the actual results of the trial and its aftermath.)

4. Obtaining Property by Deception

One Count against Lady Olenna.

Lady Olenna has routinely paid suppliers of goods and services in old gold coins that are worth half the figure that has been bargained for.

GUILTY of the lesser charge of unethical commerce, and of conducting commerce using coins not of the realm.

House Gardener-minted coins are not considered legal tender in the lands gioverned by the Iron Throne, as all coinage since the time of Aegon's Conquest has been of a different sort, coloquially known as "gold dragons", this line of coins continuing under his grace Robert Baratheon.

However mere possession of such coins is not a legal offense, nor is trade in such coins for their material value or value as part of a historical collection, so long as there is no act of overt fraud whereby payment is expected in the regular coins of the realm, but given in these coins instead. The element of outright deception is what would make it fraud. The court must recognize the principle of "caveat emptor" - the merchant has a responsibility to be wary not to merely state a sum of "gold" in a contract, but specifically "gold dragons". Being affronted after the fact does not make up for lack of caution beforehand.

SENTENCING:

Lady Margaery Tyrell is GUILTY of charge 1.1 (Treason against the true heir of House Baratheon, namely Stannis). She is found not guilty of all other charges. However, as it was the entirety of House Tyrell which made these arrangements, the court sentences her to EXILE at The Wall. She is not to be a member of the Night's Watch, she shall serve Stannis Baratheon as his hostage ward and cupbearer, until he finds for her a proper husband of noble blood or sees fit to release her. She is also stripped of any currently claimed titles with regard to being queen of anything, and her marriage to Tommen is immediately annuled.

Lady Olenna Tyrell is found GUILTY of charges 1.1 (Treason against the true heir of House Baratheon), and 2 (murder of Joffrey who is named "Baratheon").

With regard to the first charge and second charge, the defendant is sentenced to IMPRISONMENT. She shall spend the remainder of her life under house arrest - in the Water Gardens of Dorne. House Tyrell may pay a ransom to House Martell to recover her, a fine amounting to a stipend of 10000 gold dragons. Additionally, a symbolic monetary fine of 1 penny shall be paid to the crown.

As to charge 4, Lady Olenna Tyrell has also been found GUILTY of a lesser charge of "unethical business practices". On this matter, the court will levy no specific monetary fine nor punishment, but does rule that:

1 - In future, all merchants who were paid by the defendant in such coins instead of the true coins of the realm may speak openly of this without fear of reprisal, nor legal accusations of slander or libel, even within the Reach. The reputation of the defendant and her house has been used to coerce silence from nobles and smallfolk alike, but no longer. The truth shall be heard, so long as it is the truth.

2 - As well, no member of House Tyrell may conduct transactions using such unofficial coinage without making clear what sort of coins it intends to pay with, prior to the agreement of any contract. As well, the order of maesters may be contacted to verify the legality and material content of any gold paid by House Tyrell to any other noble house of the realm. The maester called shall not be in service to or a former member of House Tyrell. This condition shall be in force for the reminder of Lady Olenna's natural life.

Finally, the whole matter shall be forwarded to the Master of Laws / Justiciar, for possible legislation with regard to the use of any unofficial coinage within the Realm.

On the charges against Lady Olenna Tyrell and Lady Margaery Baratheon, this juror finds:

On the charges of Treason:

1.1: Lady Margaery: Guilty, Lady Olenna: Not Guilty. On Lady Margaery's part, this juror finds her part in Lord Renly's rebellious actions relatively small and inconsequential, and therefore advocates a lighter punishment. For her part, Lady Olenna has been known to counsel against her house's alliance with Renly.

1.2: Not Guilty. This juror does not recognize Joffrey Baratheon as rightful king of Westeros, hence treason cannot be committed against him.

1.3: Not Guilty. The amount of evidence is completely unsatisfactory.

2. Murder: Lady Margaery: Not Guilty, Lady Olenna: Guilty. By the evidence provided by Petyr Baelish, which coincides with the description of the poison used to kill the victim and her part in the way that it was brought to the scene of crime, this juror finds sufficient grounds to convict Lady Olenna. However, there is no hard evidence that Lady Margaery was a knowing part of the plot.

3. Perverting the Course of Justice: Not Guilty. While Lord Baelish's guilt is clear as day, there is no proof that the defendants were explicitly aware of the plot to frame Tyrion and Sansa Lannister.

4. Obtaining Property by Deception: Not Guilty. The evidence is insubstantial.

Verdict: On the charges brought against Lady Margaery Baratheon, this juror finds her guilty of Treason (1 count). For her part in Renly's rebellion, she is to serve 2 years in House Arrest.

On the charges brought against Lady Olenna Tyrell, this juror finds her guilty of Murder. For this, she will serve 10 years in prison.

1.Treason

Three Counts against Queen Margaery, and Two against Lady Olenna.

1.1 The Defendants jointly supported the attainted traitor Lord Renly Baratheon in his efforts to usurp the Iron Throne.

Not Guilty. The decision to support Renly Baratheon's treachery lies within Lord Mace Tyrell, head of House Tyrell and Lord Paramount of the Reach. There is also no evidence suggesting either of the defendants could have instigated Renly Baratheon and Lord Mace Tyrell's actions.

Guilty in the case against Olenna Tyrell, Not Guilty in the case against Her Grace Queen Margery Baratheon. The defendants recognized King Joffrey Baratheon as the rightful king of the Seven Kingdoms and swore oaths of allegiance to him. As such, a dismissal due Joffrey Baratheon's supposed bastardy can not be sustained.

Not Guilty. The confessions were extracted by the use of torture and are, therefore, inherently inreliable.

2. Murder.

One count against both Defendants.

The Defendants murdered his Grace, King Joffrey Baratheon, as detailed in charge 1.2 above.

Not Guilty in the case of Her Grace Queen Margery Baratheon. There is ample room for reasonable doubt in her case. Guilty in the case of Olenna Tyrell. There are testimonies involving the defendant in the crime. This juror also understands the principle of self defense, in this case of the defendant's grandaughter, would apply. However, the Law of Westeros does not recognize such a principle when the Royal Family is involved. This court refers to the case of Ser Duncan the Tall vs. Aerion Targaryen for this matter. Given the fact the afromentioned case involved one of the few Trials of the Seven ever invoked, and the Gods themselves saw fit to acquit Ser Duncan the Tall, this juror recomends leniency, unless the defendant desires to submit herself to a Trial of the Seven.

Not guilty on both cases. There is no evidence implicating Her Grace Queen Margery Baratheon. While Lady Olenna Tyrell did use Lady Sansa Lannister neé Stark to carry the poison and might have left more poison in her hairnet to implicate her, there is room for reasonable doubt.

4. Obtaining Property by Deception

One Count against Lady Olenna.

Lady Olenna has routinely paid suppliers of goods and services in old gold coins that are worth half the figure that has been bargained for.

Guilty. It is the custom of the realm to refer to the legal tender as 'gold coins'. By refusing to advertise she was to pay in a different, even if not illegal, form of gold coin with a substantial lower weight, she was, in effect, scamming her suppliers.

On the whole, this juror finds her Grace Queen Margery Baratheon not guilty on all charges.

This juror finds Lady Olenna Tyrell guilty on charge 4. and sentence her to provide monetary compensation to all the business parteners she scammed consisting in the difference they've thought they've bargained for plus punitory interests set at the highest rate payed in the realm for the time the scam took place plus 25% in concept of moral damage.

This juror finds Lady Olenna Tyrell guilty on charges 2 and 1.2. Unwilling to defy the Seven, this juror sentences her to one year of prision sentence to be served in her legal residence, with all the comforts her station allows.

In the interest of playing by the rules of the thread, I'll say their punishments should be public beheadings, but what I'm really leaning towards in sharing a crow cage in Dorne.

This juror moves to dismiss the first charge of treason. Both have already received full pardons from the Iron Throne for their actions among Lord Renly and there is no going back on that.

Queen Margaery is found innocent of all the remaining charges, as there is absolutely no evidence that she participated in any of these crimes. I move that she should be released immediately.

Lady Olenna, however, is found guilty of charges 1.2 and 2, as Lord Baelish has testified to her role in the murder. I also find her guilty of charge 3. Although she may not have known that Lord Baelish intended on framing Lady Sansa and Lord Tyrion, the fact remains that she allowed both to be blamed for the crime. Charge 4 is dismissed due to a lack of credible evidence. I recommend that Lady Olenna receive life imprisonment, to be served in a relatively comfortable cell.

I have to agree. It seems foolish to be charging them with something that Joffrey himself was ultimately okay with.

And who says we're even talking about Joffrey and Tommen ? The charges did not specify allegiance to the Lannister regime, only support of Renly in his treason and attempted usurpation of the rightful claimant.

Renly was considered a traitor by one true claimant and one false one.

Well Joffrey is king. If we're looking at this from the eyes of Stannis or someone else then they should also be charged with treason for supporting Joffrey.
