Official Court of Law v 12: Theon Greyjoy alias “Reek”

Recommended Posts

Welcome to the 12th installment of the “Official court of law” for this board. In this thread we will debate and pass judgement on character crimes. As judges we bear a burden of upholding the integrity of our court, so being impartial is imperative. Keep all arguments in a legal context that suit the standards of this court. All posters are welcome to make their case, at the end of your argument pass your judgement and sentence!!!!

The President of the Court, Lion of Judah, has been summoned to other duties, and I shall be taking his place pro-tem.

The rules: Every poster has one vote (per charge) of guilt or innocence.

**For a guilty verdict, your options are:

Send them to the Wall. (same as a life prison sentence)

Death by sword. (Clean and quick)

Death by hanging (Not so clean and quick).

Monetary fine

Exile

Stripped of land/title.

Prison sentence

Community Service

Only the nominated character will be discussed, however, you can indict characters you also find culpable, as part of your ruling, and they can be added to the docket.

**Votes can be changed before they are counted, but do so in your original post.

Posters can just cast a vote, which is your right, but try to state a case as well. Your opinion actually matters and it may serve to change the vote of another judge.

*Do not take it personally if your favorite character is being torn to pieces. Everyone is fair game.

****If votes of 'not guilty' and 'dismissed' taken together comprise over 50% of the total votes cast, the defendant is to be found 'not guilty' or the charge is to be 'dismissed', with the option that gained the most votes between the two representing the final verdict.****

NB. Following representations by numerous distinguished jurists, Death by burning alive will no longer be available as a sentence. However, Death by hanging is now an option, as is community service (the judge should state what form of community service he/she considers appropriate).

**If you find the character innocent, simply state innocent or Not Guilty after your argument.

As for as evidence that can be submitted, posters can submit any argument they deem relevant. However we cannot use any pardons (save in one instance) or prior convictions as evidence in the matter. Our court will not recognize the judgement of any other court or ruling body. In the event that a defendant is charged with an offence against another character, judges are entitled (but not obliged) to find that defendant Not Guilty, if the latter has pardoned or forgiven them.

**You can also vote for charges to be dismissed (majority rule). Any vote to dismiss charges will be treated as an acquittal, and be added to any verdicts of Not Guilty/Innocent.

**At the end of the week the vote will be counted and the final sentence carried out. Majority rules. In the event that no punishment commands a majority, then the Court will reach a consensus between the various options put forward.

The charges are outlined in the next post

Send to the Wall; let the next LC probably Thorne be his judge. Let the man who feels he is entitled to everything be treated as the least important in a band of rapists cut throats and nobles who picked the wrong side of a civil war; let him finally learn how wrong it was to be as pompous as he is by being the lowest servant anywhere. I just don't like the death penalty.

1.1: Dismissed. Changed to Miscarriage of Justice. Farlen was his subject at the time of his sentenced death, Theon was in his rights to execute him under suspicion of murder. Only, this juror thinks the amount of evidence against Farlen was not enough to deserve a death sentence.

1.2: Guilty. The defendant did order the death of that innocent subject of his without any good reason. Monetary fine.

1.3: Guilty. See 1.2 above.

1.4: Not Guilty. Kenning was beyond help, giving him death was mercy at this point.

1.5: Not Guilty. The execution was the act of Aeron Greyjoy, over which Theon Greyjoy had authority in name only.

2: Not Guilty. The defendant had captured Winterfell and thus was its rightful Lord by rights of conquest, he was entirely in his rights to humanely confine perceived threats.

3: Dismissed. Theon is an Iron Islander and a Greyjoy, he never accepted Robb as his King. Besides, Balon Greyjoy started the War with the North, and Theon cannot be held responsible for the acts of his father.

4: Dismissed. In times of war, piracy and reaving is deemed an acceptable, if somewhat dishonorable, tactic.

5: Not Guilty. The defendant was under extreme duress and threat of punishment, he cannot be held responsible for his actions.

6: Dismissed. The accusations held against him in those circumstances are simply preposterous.

Verdict: Guilty on two counts of murder.

Sentence: Would have been sent to the Wall and fined, but it is this juror's opinion that the defendant has suffered enough and should only be fined.

The Defendant is charged with having unlawfully and intentionally killed the following:-

1.1 Guilty

1.2 Guilty

1.3 Guilty for both children

1.4 Not Guilty. It was the gift of mercy

1.5 Guilty

One Count of False Imprisonment

2. Guilty. He was a ward and a guest at WF.

One Count of Treason

3. Guilty. He was a ward and a guest at WF and had accepted King Robb Stark the First of his name as his king.

One Count of Piracy

4. Not guilty.

One Count of Abetting a Forcible Marriage

5. Gulty, He allowed to Ramsay Snow (yes I am brave enough to call him Snow but snow was never so black) to torture Jeyne Poole under false allias.

One Count of Theft

6. Not Guilty. It was self-preservation not theft.

Sentence: Death by hanging (Not so clean and quick). (If Queen Mel is around she could have him as an ode to R’hillor)

1.1- Don't know if it's murder since Farlan was Theon's subject at the time. It was messed up though.....Not Guilty.

1.2,1.3- Not Guilty, the same defense as 1.1, the miller's wife(and her kids) were Theon's subjects/captives to do with as he pleased. Wasn't his other option to burn WF and kill everyone anyways?

1.4- Not Guilty, Ralf was slowly dying and if I remember correctly he couldn't even express his opinions by that point.

1.5- Not Guilty.Benfred was a captive of war. You spit in your captors eye, don't be shocked if he kills you.

2.1- Not Guilty, Bran, Rickon, and Luwin (don't think he was imprisoned) were all Theon's captives by that point; Theon had the right.

3.1- Not Guilty, I don't recall Theon swearing Robb any oaths of fealty. It was wrong of him to "betray" Robb but not from a legal standpoint.

4.1- Not Guilty, following his father's orders. His actions are justifiable by war standards IMO.

5.1- Not Guilty, he was a prisoner, and he probably would have died had he said anything about it. Can't blame him from a legal or moral standpoint.

6.1- Guilty, but totally justifiable IMO. Ramsay was the ruler of the DF and made his call even if it was a dick move.

Verdict: Theft of one rat from the DF.

Sentence: I'd say a monetary fine to pay the miller and other relatives of the people he killed in WF, Wall, or community serveice if he fights the others anyway. A copper to Roose or Ramsay if they press the issue of theft.

For the record I think all of the above acts were pretty fucked up(except 6) but judged by the laws of Westeros I can't find much legal fault in them. Moral? Yes. Also like to add the murder of Theon's own men that he more than likely ordered Reek(Ramsay) to commit and the intent to prosititute Palla(the chick he was going to give to Ramsay). Also, the guy he killed with a bow for being drunk and looting in his 3rd chapter in ACOK.

Five Counts of Murder:-

The Defendant is charged with having unlawfully and intentionally killed the following:-

1.1 Goodman Farlen, the Kennelmaster of Winterfell.

Not Guilty. Through right of conquest Theon was the Legal lord of Winterfell, and as lord was well within his rights for the execution.

1.2 One unnamed miller’s wife.

Guilty, it is unlawful to execute a person innocent of crimes.

1.3 The children of the said miller’s wife.

Guilty, it is unlawful to execute a person innocent of crimes.

1.4 Ralph Kenning, garrison commander of Moat Cailin.

Not Guilty, I forget the legal term, but its why Dr. Kevorkian never goes to jail for the assisted suicides.

1.5 Master Benfred Tallhart

Not Guilty, it was The Damphair who actually commited the crime, and the Ironborn can lawfully drowned captured prisoners of war.

One Count of False Imprisonment

2. The Defendant is charged with falsely imprisoning Lords Bran and Rickon Stark, Maester Luwin, and the servants of Winterfell.

Not Guilty, as the lawful lord of Winterfell, Theon was entitled to protect his wards who are Starks in any manner he see's fit. They were not chained or improsoned in cells, so I move to dismissal for this charge.

One Count of Treason

3. The Defendant is charged with waging war against Lord Robb Stark, whom he had accepted as his King.

Guilty! Theon bent the knee and swore to Robb, and was chanting King of the North with all the rest of the Northern and River lords.

One Count of Piracy

4. The Defendant is charged with having reaved the Stony Shore, as commander of the ship “Sea Bitch”.

Not Guilty, reaving is lawfully accepted as part of war for the Ironborn.

One Count of Abetting a Forcible Marriage

5. The Defendant is charged with having abetted a forcible marriage, by giving away Mistress Jeyne Poole, alias Lady Arya Stark, to be married to Lord Ramsay Bolton, against her express wishes.

Not Guilty under extreme circumstances. Roose and Ramsay should be charge with perjury and extortion.

One Count of Theft

6. The Defendant is charged with having eaten rats in the dungeon of the Dreadfort,

without having received the permission of their owner, Lord Roose Bolton, Warden of the North.

By all the laws of Westeros, he is guilty, and may Roose show mercy for this heinous crime.

EDIT: Verdict: Guilty of 2 counts of murder, treason, and theft. Sentence should be death by hanging

This argument doesn't hold up. The defendant knowingly false testified against Farlen in an effort to protect Ramsay Bolton. He was the jury and judge in a case where he knew all of the facts yet chose to ignore them, lied and executed the victim. Conquest has absolutely nothing to do with this.

ETA: Also your argument and verdict on charge 1.3 contradicts your argument and verdict on charge 1.1

Honestly, I can't remember what exactly happened, except that this was the execution Theon botched. In Westeros, the lord of a castle executes criminals who break the law. Again, I can't remember the exact crime Farlen commited, but commit a crime he did, and Theon was well within his rights as the lawful lord of Winterfell to execute the criminal.

Here is the passage in question: "Farlen was as likely a suspect as any, so Theon sat in judgment, called him guilty, and condemned him to death. Even that went sour. As he knelt to the block, the kennelmaster said, "M'lord Eddard always did his own killings." Theon had to take the axe himself or look a weakling. His hands were sweating, so the shaft twisted in his grip as he swung and the first blow landed between Farlen's shoulders. It took three more cuts to hack through all that bone and muscle and sever the head from the body, and afterward he was sick, remembering all the times they'd sat over a cup of mead talking of hounds and hunting."

He was blamed for the deaths committed by men loyal to Theon.

Farlan didn't commit any crime. But was it breaking any law to have Farlan killed when Theon ruled WF?
