I think you may be confusing the legal position with what a powerful man can get away with in Westeros.

Lord Roose Bolton committed a crime when he raped the miller's wife; Ramsay Bolton committed a crime when he raped and murdered Lady Hornwood; Ser Jorah Mormont committed a crime when he sold poachers into slavery; Ser Gregor Clegane committed a crime when he burned the village in the Riverlands. Lord Tywin Lannister committed a crime when he ordered his men to gang-rape Tysha. But, some of them got away with it.

The first three are only apllicable because of the rules laid down by the Starks, their leige lords at the time. And Gregor and Tywin didn't just "get away with it", people know they did it and they know it was wrong but they don't get called on it. I guess I'll look at these acts from more of a moral standpoint than a fuedal one.

The Court has now reached its verdict in respect of the Defendant.

Five Counts of Murder:-

1.1 Goodman Farlen. Guilty 18, Not Guilty 10.

1.2 One unnamed miller's wife. Guilty 25. Not Guilty 4.

1.3 Unnamed children of the said miller's wife. Guilty 26, Not Guilty 3.

1.4 Ralph Kenning. Guilty 6, Not Guilty 23.

2. One count of unlawful imprisonment. Guilty 7, Not Guilty 21.

3. Treason. Guilty 16, Not Guilty 12 (with one verdict of Guilty of Oathbreaking).

4. One count of piracy. Guilty 12, Not Guilty 17.

5. One count of abetting a forcible marriage. Guilty 4, Not Guilty 25.

6. One count of theft. Guilty 7, Not Guilty 22.

The Defendant is therefore found Guilty of three counts of murder, and one count of treason.

The Defendant is found Not Guilty of two counts of murder, one count of false imprisonment, one count of piracy, and one count of theft.

The Defendant is the son of the late Lord Balon Greyjoy, the deceased Lord of the Iron Islands. For much of his life, he was raised by Lord Eddard Stark as a ward, at Winterfell. When Lord Robb Stark called his banners, he fought under his command with distinction, and was sent by Lord Stark as an ambassadord to his father in Pyke, to offer an alliance.

The Defendant's father rejected the proposed alliance. Subsequently, the Defendant led an attack on Lord Stark's lands, with 8 ships under his command, and then seized and captured Winterfell, Lord Stark's seat.

The Defendant has been found Guilty of treason to Lord Stark, who has made a claim to King in the North and Riverlands. This Court neither accepts nor rejects the validity of that claim, but we have found that the Defendant accepted Lord Stark as his King, and was therefore a traitor to him. The Defendant has further been found Guilty of three counts of murder:- namely, Goodman Farlen, Kennelmaster of Winterfell, and an unnamed miller's wife, and her sons.

There is very little that can be put forward in mitigation for the Defendant. He betrayed the man he had acknowledged as his King, and at no stage did he indicate that he had renounced allegiance to him. Worse, he committed four murders, solely in order to impress the inhabitants of Winterfell with the severity of his rule. This Court treats the murder of smallfolk as being a serious crime, in no way mitigated by the social status of their murderer. The Court notes, however, that the Defendant has been subject to months of phyiscal and psycological torture by Lord Ramsay Bolton, and has helped to liberate Jeyne Poole.

The Court notes that 14 Judges, out of 29 who have recommended a sentence, have recommended that the Defendant be sentenced to death (8 by the sword, and 6 by hanging). A further 7 have recommended that he be sentenced to a lifetime of service with the Night's Watch (and several have explicitly stated that the Defendant deserved death, and this was an optional alternative). 5 judges have recommended that the Defendant be sentenced to a monetary fine, one has recommended "leniency" and one has recommended exile.

One judge has recommended death by the sword, but has granted to Lord Jon Snow, the option of inducting the Defendant into the Night's Watch as an alternative.

Therefore, fourteen judges have recommended a mandatory capital sentence, fourteen have recommended non-capital sentences, and one has recommended an optional death sentences.

It is therefore the sentence of this Court that the Defendant be beheaded by the sword, but that the Defendant shall have the option of having his sentence commuted to a lifetime of service with the Night's Watch, subject to the agreement of the Lord Commander, and upon pain of death should he ever desert.

On the charges against Theon Greyjoy, Prince of the Iron Islands, this juror finds:

On the charges of Murder:

1.1: Guilty. The defendant was aware of the victim's innocence.

1.2: Guilty.

1.3: Guilty.

1.4: Not Guilty. There is no definitive proof that the defendant was complicit in the execution of the garrison.

1.5: Guilty. The victim was a prisoner of war when he was killed.

2: False Imprisonment: Guilty. The defendant's claim to Winterfell was openly contested, so he cannot claim lordship by right of conquest.

3. Treason: Not Guilty. The defendant has never explicitly sworn an oath of fealty to Robb Stark, and his wardship ended when he was returned to the Iron Islands, thus ending the lord of Winterfell's claim to his person.

4. Piracy: Guilty. The defendant clearly ordered and engaged in activities directed towards non-military targets.

5. Abetting a Forcible Marriage: Guilty.

6. Theft: Not Guilty. Ramsay Bolton was not lord of the Dreadfort, hence he cannot make laws without the consent of the actual lord, Roose Bolton.

Verdict: On the charges against Theon Greyjoy, this juror finds him guilty of: Four counts of Murder (1.1, 1.2, 1.3 and 1.5), False Imprisonment, Piracy and Abetting a Forceful Marriage. This juror therefore sentences him to Death by Sword.
