On the charges against Ser Gregor Clegane, this juror finds:

  1. Murder: Not Guilty of case 1, Guilty of case 2. While the defendant's murderous intent at the tourney was apparent the very next day, there is substantial doubt that the defendant was indeed intent on killing Ser Hugh, and the defendant will not be found guilty on voluntary manslaughter. This juror finds, however, that the defendant is guilty of Lord Lyman Darry, who was not a military target.
  2. Genocide: Guilty. The devastation of the Riverlands was apparent and carried out deliberately.
  3. Rape: Guilty.
  4. Slavery: Guilty. The captives at Harrenhall were civilians, not military prisoners of war, and the defendant had thus no right to force put them to labor against their will.
  5. Torture: Guilty. Again, this was conducted on civilians, not military targets.
  6. Theft: Guilty.
  7. Arson: Guilty.
  8. Vandalism: Guilty.
  9. Kidnapping: Guilty. Whatever her given identity, Arya Stark was taken against her will.
  10. Treason: Guilty. The king's men did not hide their identity nor the authority that had been handed to them by the crown.
  11. Assault: Guilty.

Verdict: On the charges against Ser Gregor Clegane, this juror finds him guilty of Genocide, Rape, Slavery, Torture, Theft, Arson, Vandalism, Kidnapping, Treason and Assault, and partially guilty of Murder. The defendant will be sentenced to Death by Sword. For the damage done against the people and lords of the riverlands, his house shall provide financial reparations of 1 million golden dragons, to be delegated amongst the lands that suffered in accordance with the damage inflicted. In addition, the status of House Clegane will be considered suspended for a period of twenty years, during which the actions of its members will be held under scrutiny. Should any member be found guilty of a serious offense during this time, or should the monetary recompense to the Riverlands remain unpaid, the house will be abolished as knightly house. Should all legal heirs die with any debt in regards to this case unsolved, these debts will be transferred to House Lannister, its liege lord.

This court call upon the defendant Ser Gregor Clegane, alias ‘The Mountain,’ Knight of Clegane’s Keep and charge him with:

Charge 1) 2 Counts of murder-During a competitive joust Ser Gregor intentionally and successfully sort to cause fatal injury to Ser Hugh of the Vale. Ser Clegane upon invading the Riverlands successfully attacked castle Darry, killing 8 year old Lord Lyman Darry.

As to count 1A ) murder during a joust, we find no evidence given of intent, and clear the defendant of the charge. A charge of negligence causing death is unwarranted, because of physical evidence that Sr Hugh's armour was not correctly fastened, and the sport carries inherent risks. Therefore, it would have to be proved beyond mere accusation that Ser Gregor's intent was the death of Ser Hugh, something which cannot be proven.

VERDICT = NOT GUILTY

Count 1B ) That the defendant attacked the Riverlands without expressed command of the lawful King, Robert Baratheon I, and while under sentence of death from the lawful Hand of the King, Eddard Stark, is another sort of crime (banditry), but being a crime it cannot be considered an act of war. Furthermore, the specific victim was 8 years old, and helpless. The resultant death of this child would be considered the murder of a prisoner under wartime rules, and outright murder under peacetime rules.

VERDICT = GUILTY

Charge 2) Genocide-Ser Gregor Clegane committed unwarranted acts of genocide against the people of the Riverlands.

All told, tens of thousands thousands of sodliers and non-combatants of the Riverlands are known to have suffered under the forces of House Lannister, as ordered by Tywoin Lannister. As one of the chief war leaders of these forces, Ser Gregor Clegane not only carried out these unlawful orders starting when King Robert I was still on the throne, but well into the war afterwards, his forces being known for the savagery of their attacks on non-combatants, their use of torture and rape for both psychological terror and also their own entertainment. They worked and tortured captives to death, and engaged in thousands of summary executions. Dwellings were burned whather they surrendered or not, people executed in like manner, and food stocks and livestock either destroyed or stolen. The entire region was devastated by these assaults, and many entire families and towns were wiped out. Furthermore, the defendant personally engaged in these activities, personally murdering, personally raping, personally torturing, personally destroying or stealing property and livestock. No attempt was made to conceal these activities, and in fact it was openly spoken of among both sides of the conflict.

The defence that he was following orders cannot be used by the defendant as it was not ordered by a lawful authority. At the outset, it was contrary to the King's Peace, and as enacted by the Hand of the King, Eddard Stark, under the King's laws, that supercedes any orders given by House Lannister. Furthermore, as the usurpation of the Iron Throne was accomplished by an unlawful coup d'etat, orders to continue this activity from "King" Joffrey or Tywin Lannister cannot be considered legitimate, even if one were to discount the plainly abhorrent activities the defendant felt obliged to engage in.

VERDICT = GUILTY.

Charge 3) Rape-Upon sacking Stony Hedge the seat of House Bracken, Ser Gregor Clegane sexually assaulted and raped one of Lord Jonos Bracken daughters.

VERDICT = GUILTY.

Charge 4) Slavery-Many survivors of Ser Cleganes’ attacks throughout the Riverlands were taken to Harrenhal Castle, where they forced into labor and abused directly by his command and Ser Clegane himself.

VERDICT = GUILTY

Charge 5) Torture-Ser Clegane stood by while ‘Tickler’ carried out acts of torture at his command. According to witness Chiswyck "Tickler makes them howl so hard they piss themselves..."

Charge 6) Theft-Upon sacking the many castles of the Riverlands Ser Gregor stole all of the castles food supplies.

VERDICT = GUILTY

Charge 7) Arson-Ser Gregor burnt the Castle Stoney Hedge along with it’s unharvested crops.

VERDICT = GUILTY

Charge 8) Vandalism-We seek to charge Ser Gregor with vandalism for the above acts as well.

For arguments, see count 2, above.

VERDICT = GUILTY

Charge 9) Kidnapping-While this charge may seem to be a reach, this court argues that the forceful taking of Lady Arya Stark of Winterfell should be deemed as kidnapping in the eyes of judges in this court. Ser Gregor was not aware of Lady Arya Stark, but the act of taking her against her will should not be dismissed.

VERDICT = GUILTY.

However the court should note the identity of the victim in question is legally irrelevant. The defendant was under the care of the Night's Watch, and their service was unlawfully interfered with by an accomplice of the defendant, Ser Amory Lorch. Upon capture by the defendant's men, the defendant unlawfully confined her and a group of others, tortured some and subjected the survivors to forced labour. This is already covered above, in the war crimes described under count 2.

Charge 10) Treason-Ser Gregor openly attacked men ordered by the Hand of the King Lord Eddar Stark of Winterfell and carrying the banner of King Robert Baratheon when they sort to bring him in to answer for his many atrocities. This attack was no different from an attack on the king himself.

VERDICT = GUILTY.

The attack upon Ser Beric Dondarrion, who was under lawful orders to apprehend or kill the defendant, was entirely unlawful. An attack upon the King's men which was in effect waging war against the King himself. Such actions are not indicative of lawful warfare, but rather a crime - and treason is its name.

Charge 11) Assault (against Kingsmen)-For the act of resisting arrest this court finds that Ser Gregor’s actions warrant a charge of assault.

VERDICT = GUILTY. The defendant is guilty of assault, and indeed, murder. Plus, as covered by charge #10, doing so against the King's men in arms constitutes treason.

The defendant has been found GUILTY of the following charges:

1B ) Murder of Lord Lyman Darry, a child of eight

2) Genocide and sundry war crimes against the people of the Riverlands. This includes charges of rape, murder, torture, arson, assault, destruction of property and livestock, abduction, forced labour, and armed banditry (as covered in charges 1B, 3, 4, 5, 6, 7, 8, and 9.

10 and 11) Treason, murder and assault upon the King's men.

The defendant has been found NOT-GUILTY on one charge:

1A) Murder of Ser Hugh of the Vale, in a joust.

For his crimes, the court sentences Ser Gregor Clegane to DEATH, by the process of blinding, gelding, flaying, and then death by FIRE. The court will hear petitions for mercy from any religious figure that deems it appropriate to comment, and if the court is convinced, the execution shall merely be death by fire.

All the surviving men under his command who particpiated in these acts are to be put to death, regardless of rank or noble title. Any men who did not participate, but merely watched can be sent to the Night's Watch. (Note: "Men" in this instance shall include those trained in arms or participating in battle or garrison duty under him, even those underage.)

For the nonce, the chattels possessed by House Clegane and by Ser Gregor's men are subject to seizure and use as war reparations to the people of the Riverlands, pending further investigation of how they were gained. The lands and incomes of House Clegane shall remain with House Clegane, but pending investigation of the preceding deaths of people in that area and their causes. If these lands prove untainted by foul deeds, and if the defendant's brother Sandor presents himself to make petition, they may pass back to him as heir of House Clegane.

Sentence: While death would be appropriate, I cannot overlook the value of sending Clegane to the Wall. He'd make a magnficent ranger.

Honourable fellows of the aSoIaF boards! I hereby present my findings on the following...

Charge 1) 2 Counts of murder-During a competitive joust Ser Gregor intentionally and successfully sort to cause fatal injury to Ser Hugh of the Vale. Ser Clegane upon invading the Riverlands successfully attacked castle Darry, killing 8 year old Lord Lyman Darry.

First count: Innocent. There is not any evidence that this was deliberate, as much as it is likely that he did do it. Accidents do happen and tournaments are dangerous. The fight happened before the King and his Court and none saw fit to prosecute.

Second count: Guilty, and doubly so. His actions were malicious, planned and calculated.

Sentence: Death by fire, fitting given his torture of his brother.

Charge 2) Genocide-Ser Gregor Clegane committed unwarranted acts of genocide against the people of the Riverlands.

There is no such thing as a warranted act of genocide, is there? :o

In any case, Guilty, just as the Hand of the King Eddard Stark decided.

Sentence: Death by fire! >:D

Charge 3) Rape-Upon sacking Stony Hedge the seat of House Bracken, Ser Gregor Clegane sexually assaulted and raped one of Lord Jonos Bracken's daughters.

Guilty! His lack of remorse is particularly chilling and he has admitted to other rapes, even if not this one.

Sentence: Confiscation of his penis.

Charge 4) Slavery-Many survivors of Ser Cleganes’ attacks throughout the Riverlands were taken to Harrenhal Castle, where they forced into labor and abused directly by his command and Ser Clegane himself.

Verdict: Guilty! The testimonies of the people seem to suggest that this is completely true. Similarly, Jaime Lannister seems to say as much and he is party of Clegane's Overlord House.

Sentence: Death by fire.

Charge 5) Torture-Ser Clegane stood by while ‘Tickler’ carried out acts of torture at his command. According to witness Chiswyck "Tickler makes them howl so hard they piss themselves..."

Verdict: The testimonies against him seem too much to ignore, therefore Guilty! Not only that, but it seems that he dismembered people in at least one case and fed them their own limbs.

Sentence: Flaying, before his death by fire.

Charge 6) Theft-Upon sacking the many castles of the Riverlands Ser Gregor stole all of the castles' food supplies.

Verdict: Innocent. There's no proof that he actually stole anything. He seems to have burnt it all down and there's not much that he can carry on only one horse. Furthermore, without evidence of a caravan or wagon, he cannot be said to have stolen anything.

Charge 7) Arson-Ser Gregor burnt the Castle Stoney Hedge along with its unharvested crops.

Verdict: Guilty. This act was ordered by his Overlord Tywin Lannister but was not even close to a reasoned response to the kidnap of Lannister's son. Also, since Catelyn Stark, nee Tully, was now within the household of Stark, it makes even less sense.

Sentence: Stripped of all lands and titles.

Charge 8) Vandalism-We seek to charge Ser Gregor with vandalism for the above acts as well.

Verdict: Guilty. It seems that it's true, though it's hardly concerning given his other crimes.

Sentence: A stern talking to.

Charge 9) Kidnapping-While this charge may seem to be a reach, this court argues that the forceful taking of Lady Arya Stark of Winterfell should be deemed as kidnapping in the eyes of judges in this court. Ser Gregor was not aware of Lady Arya Stark, but the act of taking her against her will should not be dismissed.

Verdict: Innocent. His actions seemed to protect her and it was his intention to seek a reward for her. It can therefore be safely assumed that he was going to ensure her safe return.

Charge 10) Treason-Ser Gregor openly attacked men ordered by the Hand of the King Lord Eddar Stark of Winterfell and carrying the banner of King Robert Baratheon when they sort to bring him in to answer for his many atrocities. This attack was no different from an attack on the king himself.

Verdict: Guilty. Even though his actions could be seen as self-defence, his crimes were already condemned and sentenced. His actions also prove that he has no sense of remorse or care for consequences.

Sentence: Death by fire, after the flaying. Perhaps over a long period, say, 10 months.

Charge 11) Assault (against Kingsmen)-For the act of resisting arrest this court finds that Ser Gregor’s actions warrant a charge of assault.

Verdict: Dismissed. This is the same as the more serious charge above.

There is not enough evidence to prove that Ser Fervor intended to kill Ser Hugh. Jousting is a dangerous sport and dinettes accidents happen.

Rape-guilty

Slavery-guilty. Most of the people being forced to labor for Ser Gregor were non-combatants whose only crime was living in the Riverlands,therefore they are not considered POW's.

Torture-guilty

Arson, theft, and vandalism- guilty for the crimes committed before the death of King Robert Baratheon.

Kidnapping-guilty. See explanation for slavery and I move for this charge to include all the innocents Ser Gregor captured during his reign of terror in the Riverlands.

Treason-guilty

Assault of the kingsmen-dismissed. This is a redundant charge covered under treason.

Sentence.

I sentence Ser Gregor Clegane, aka The Mountain that Rides, to death by fire. May the gods have mercy on your soul.

Incidentally, has the President of the Court considered hanging, drawing, and quartering as one of the available options?

While it is a deserved punishment our goal is justice, not revenge so I won't say yea or nay. If you guys want to vote on it, then someone draw it up and if it passes by majority then it's in. Though I would caution our goal is justice, not revenge. :drunk:

Before rendering judgement on the 11 charges specified above, I would like to call attention to the heinous crimes Gregor Clegane committed during Robert's Rebellion:

A. Regicide and high treason. At the fall of King's Landing Gregor Clegane murdered Prine Rhaegar's son Aegon by smashing his head against the wall in his nursery. Clegane admitted to this crime during a trial by combat against Oberyn Martell in A Storm of Swords. Since his father Rhaegar and Grandfather King Aerys were already dead, the infant Aegon was the King when Clegane murdered him.

B. Rape and murder. After killing Aegon, Clegane raped and murdered Elia (Martell) Targaryen, Aegon's mother. Clegane also admitted this crime during the previously cited trial by combat.

Sentence for these crimes - beheading.

Regarding the more recent crimes cited in the original list above:

Charge 1) 2 Counts of murder-During a competitive joust Ser Gregor intentionally and successfully sort to cause fatal injury to Ser Hugh of the Vale. Ser Clegane upon invading the Riverlands successfully attacked castle Darry, killing 8 year old Lord Lyman Darry.

Verdict on murder, count 1: Not guilty - no evidence of intent.

Verdict on count 2: Not guilty - no testimony that Clegane personally killed Lyman Derry. He died during the attack on his castle by Lannister forces led by Clegane during the War of the Five Kings.

Charge 2) Genocide-Ser Gregor Clegane committed unwarranted acts of genocide against the people of the Riverlands.

Verdict: Dismissed - Genocide is not simply murder, but a crime targeting a specific racial or ethnic group.

Charge 3) Rape-Upon sacking Stony Hedge the seat of House Bracken, Ser Gregor Clegane sexually assaulted and raped one of Lord Jonos Bracken daughters.

Verdict: Guilty; Sentence: Take the Black (Night's Watch) or castration.

Charge 4) Slavery-Many survivors of Ser Cleganes’ attacks throughout the Riverlands were taken to Harrenhal Castle, where they forced into labor and abused directly by his command and Ser Clegane himself.

Verdict: Dismissed - There is no indication that forcing captives to work is a crime in Westeros.

Charge 5) Torture-Ser Clegane stood by while ‘Tickler’ carried out acts of torture at his command. According to witness Chiswyck "Tickler makes them howl so hard they piss themselves..."

Verdict: Dismissed - There is no evidence that torturing prisoners to obtain information is illegal in Westeros.

Charge 6) Theft-Upon sacking the many castles of the Riverlands Ser Gregor stole all of the castles food supplies.

Verdict: Not guilty. This was an act of war, not a crime.

Charge 7) Arson-Ser Gregor burnt the Castle Stoney Hedge along with it’s unharvested crops.

Verdict: Not guilty. This was an act of war, not a crime.

Charge 8) Vandalism-We seek to charge Ser Gregor with vandalism for the above acts as well.

Verdict: Not guilty. As per 6) and 7) above.

Charge 9) Kidnapping-While this charge may seem to be a reach, this court argues that the forceful taking of Lady Arya Stark of Winterfell should be deemed as kidnapping in the eyes of judges in this court. Ser Gregor was not aware of Lady Arya Stark, but the act of taking her against her will should not be dismissed.

Verdict: Not guilty. Arya was a prisoner of war, not a kidnapping victim.

Charge 10) Treason-Ser Gregor openly attacked men ordered by the Hand of the King Lord Eddar Stark of Winterfell and carrying the banner of King Robert Baratheon when they sort (sic.) sought to bring him in to answer for his many atrocities. This attack was no different from an attack on the king himself.

Verdict: Not guilty. By the time Gregor attacked these men, Joffrey was King and the decrees of Ned Stark were null and void.

Charge 11) Assault (against Kingsmen)-For the act of resisting arrest this court finds that Ser Gregor’s actions warrant a charge of assault.

Verdict: Not guilty. As per 10) above.

Overall, for crimes committed during Robert's Rebellion: Guilty, Death by beheading. For crimes committed after Robert's Rebellion, specifically Charge 3: Night's Watch or castration.

Welcome to the 7th installation of the “Official court of law” for this board. In this thread we will debate and pass judgement on character crimes from the work ASOIAF. As judges we bear a burden of upholding the integrity of our court so being impartial is imperative, keep all arguments in a legal context that suit the standards of this court. All posters are welcomed to make their case, at the end of your argument pass your judgement and sentence!!!!

The rules: Every poster has one vote (per charge) of guilt or innocence.

**For a guilty verdict, your options are:

  • Send them to the wall. (same as prison sentence)
  • Death by sword. (Clean and quick)
  • Death by flames. (An ode to R’hllor)
  • Death by flaying. (oh boy)
  • Monetary fine
  • Exile and/or
  • Stripped of land/title.
  • Prison sentence

**If you find the character innocent, simply state innocent after your argument.

As for as evidence that can be submitted, posters can submit any argument they deem relevant. However we cannot use any pardons or prior convictions as evidence in the matter. Our court will not recognize the judgement of any other court or ruling body.

**You can also vote for charges to be dismissed (majority rule).

**At the end of the week the vote will be counted and the final sentence carried out. Majority rules. Only the nominated character will be discussed, however, you can indict characters you also find culpable, as part of your ruling, and they can be added to the docket.

**Votes can be changed before they are counted, but do so in your original post.

Posters can just cast a vote, which is your right, but try to state a case as well. Your opinion actually matters and it may serve to change the vote of another judge.

*Do not take it personally if your favorite character is being torn to pieces. Everyone is fair game.
