Welcome to the 9th installation of the “Official court of law” for this board. In this thread we will debate and pass judgement on character crimes from the work ASOIAF. As judges we bear a burden of upholding the integrity of our court so being impartial is imperative, keep all arguments in a legal context that suit the standards of this court. All posters are welcomed to make their case, at the end of your argument pass your judgement and sentence!!!!

The rules: Every poster has one vote (per charge) of guilt or innocence.

**For a guilty verdict, your options are:

  • Send them to the wall. (same as prison sentence)
  • Death by sword. (Clean and quick)
  • Death by flames. (An ode to R’hllor)
  • Monetary fine
  • Exile and/or
  • Stripped of land/title.
  • Prison sentence

**If you find the character innocent, simply state innocent after your argument.

As for as evidence that can be submitted, posters can submit any argument they deem relevant. However we cannot use any pardons or prior convictions as evidence in the matter. Our court will not recognize the judgement of any other court or ruling body.

**You can also vote for charges to be dismissed (majority rule).

**At the end of the week the vote will be counted and the final sentence carried out. Majority rules. Only the nominated character will be discussed, however, you can indict characters you also find culpable, as part of your ruling, and they can be added to the docket.

**Votes can be changed before they are counted, but do so in your original post.

Posters can just cast a vote, which is your right, but try to state a case as well. Your opinion actually matters and it may serve to change the vote of another judge.

*Do not take it personally if your favorite character is being torn to pieces. Everyone is fair game.

****If votes of 'not guilty' and 'dismissed' taken together comprise over 50% of the total votes cast, the defendant is to be found 'not guilty' or the charge is to be 'dismissed', with the option that gained the most votes between the two representing the final verdict.****

This court now call upon Lady Catelyn Stark of Winterfell alias 'Lady Stoneheart,' alias 'Mother Merciless' and charge her with:

Charge 1A.-(Kidnapping)This court charges Lady Catelyn Stark with the kidnapping of one Lord Tyrion Lannister of house Lannister. Lady Catelyn impeded Lord Tyrion's travel and forcefully took him to the Vale against his will to stand trial for charges unfounded.

Charge 1B.-Lady Catelyn now know as 'Lady Stoneheart', led a band of outlaws known as 'The Brotherhood Without Banners' in the act of kidnapping and ransoming one Petyr Frey.

Charge 2-(Miscarriage of Justice) Because of said actions this court charges Lady Catelyn with a miscarriage of justice. Lady Catelyn invoked the Kings Justice and was not called upon by the king to lawfully carry justice out in his name. **Lady Catelyn was also advised by her uncle Blackfish Tully that her sister Lady Lysa of the Vale did not have the mental capacity to carry out justice in the kings name. His warnings were ignored even after Lady Catelyn saw Lysa's mental state first hand.

Charge 3-(Reckless Endangerment) To conceal and evade capture with her prisoner Tyrion Lannister, Lady Catelyn took her traveling party through the most dangerous region of the Vale. This act led to them being attacked by the Vale clansmen, endangering the life of her illegal captive.**After his acquittal of faulty charges initiated by Lady Catelyn Lord Tyrion had no choice but through a road in which capture by Vale Clansmen was imminent.

Charge-4(Inciting riots/chaos/war) Lady Catelyn's actions of kidnapping Tyrion Lannister, provoked a military response by his father Warden of the West Lord Tywin Lannister. A response that would not have occurred had she not unlawfully seized Tyrion Lannister.

Charge 5-(Treason) Lady Catelyn unbeknownst to the King in the North negotiated with the enemy and agreed to terms without the kings knowledge. She released a prisoner of considerate value to the king and his allies "The King Slayer.' This court sites as precedence the trial of Alester Florent charge 3 'collusion'.

Charge 6-(child neglect) Lady Catelyn is accused of neglecting the child of her husband Lord Eddard Stark from the day he was brought to Winterfell. Lady Catelyn actively spoke against the victim Jon Snow's character when given the opportunity. This court sites as evidence the conversation between Lady Catelyn and The King in the North Robb Stark in which she sort to convince Robb against legitimizing his brother because he was a bastard and bastards are treacherous.

Charge 7-(Attempted Murder)-Lady Catelyn now known as Lady Stoneheart upon finding Brienne of Tarth and her companion Podrick Payne, ordered her band of outlaws to hang Podrick Payne, a young man with no prior knowledge or dealings with her. The act was only halted once Brienne of Tarth forcefully agreed to Lady Catelyn's terms.

Charge 8-(Murder)1A.-Lady Catelyn and her band of outlaws had no interest in ransoming Petyr Frey and hanged him by the neck until he was dead before their requested ransom was paid.

1B.-Despite his claims to have taken no part in the Red Wedding, Merret Frey was also hanged from the neck until dead while trying to pay the requested ransom for Petyr Frey. No effort was made by Lady Catelyn to corroborate or discredit Merret's claims of innocence in the act.

Charge 9-(Assault)-A charge of assault is warranted for her actions against Podrick Payne as severe bodily harm was done to him as a result of Lady Catelyn now known as Lady Staoneheart orders.

I find the defendant, Lady Catelyn of House Stark and Tully guilty of all charges except child neglect, of which she is not guilty. She was cold to Jon Snow and did not trust him, but never victimised him. The defendant should pay a monetary fine and be exiled to the Free Cities for five years.

Guilty on all counts save Charge 6. While the treatment was unfortunate and wrong it did not affect Jon Snow's standard of living or state of being with any significant long term effects.

My personal opinion is that Lady Stoneheart and Catelyn Stark should not be tried as the same person, however, her charges during life (especially releasing Jaime) would ultimately lead to death (less likely, son of the King in her territory) or more likely life long imprisonment with the option of joing the silent sisters. Considering Catelyn Stark is already dead and has therefore arguably served her punishment for crimes prior to resurrection I will name my sentence as a result of Lady Stoneheart's crimes instead.

Lady Stoneheart is falsely representing the King's Justice, holding unfair / illegal trials and, while most of her victims deserve it, she herself is not above the law. Death by sword.

Charge 3: Not Guilty. Catelyn was actually trying to protect her party by throwing off the Lannisters and she cannot be held accountable for the actions of the clansmen.

Charge 4: Not Guilty. Catelyn cannot be held accountable for the actions of Tywin Lannister, who responded with what can be considered a miscarriage of justice.

Charge 5: Guilty

Charge 6: Not Guilty. Jon was not neglected. He was adequately housed, clothed, fed, and educated by the Stark family. Catelyn was under no obligation to legitimize Jon so he can inherit Winterfell, nor did she break any laws.

Charge 7: Not Guilty. We do not have enough information to determine what actually happened and what LS' terms are, but it appears LS and the BwB willing let Brienne and Pod free.

Charge 8 (1A) Guilty

Charge 8 (1B): Guilty

Charge 9: Not Guilty. Not enough evidence to determine if severe bodily harm was done to Podrick Payne.

For the guilty charges, I sentence Lady Catelyn Stark/LS to the Silent Sisters.

What? She was there and saw him there as well. He was lying because he assumed all the Stark men from the Red Wedding had been killed, but didn't count on Cat still being alive and being able to finger him as an accomplice.

And I'm surprised killing Jingle Bell is not on the list of charges although I might acquit her for temporary insanity on that one.

Charge 3-(Reckless Endangerment): Verdict: Not Guilty, Lady Stark cannot be held responbsible for the actions of the Wildlings of the Mountains of the Moon

Charge-4(Inciting riots/chaos/war): Verdict: Not Guilty, Lady Stark cannot be held responsible for the actions of Tywin Lannister

Charge 5-(Treason) Verdict: Guilty

Sentence: Prison sentence, Lady Stark is to be confined to a castle of the court's choosing for a period to be determined

Charge 6-(child neglect) Verdict: Not Guilty, Lady Stark is not Jon Snow's mother and never agrees to take any role in his care, she has no duty of care towards the child and this judge has seen no evidence that he was neglected

ETA: For the murder charges I was sorely tempted to sentence her to death by sword and then suspend the sentence on the grounds that it had already been carried out

Count 4 - Not Guilty: Tywin Lannister sent his bannermen to burn down villages in the Riverlands, Catelyn cannot be hold responsible for his actions

Count 6 - Not Guilty: Given the precedent with Theon Greyjoy, Catelyn`s concerns are understandable, also she had no obligations toward Jon

1B) Guilty... of pursuing the law of her own accord without the expressed privilege of the court.

2) Guilty, similarly to 1B

3) Guilty

4) Not guilty. Tywin commited those acts, she did not manipulate him forcibly to do so, he merely retaliated and was by no means needed to do so in such immense fashion.

5) Guilty.

6) Not Guilty. For one, bastards are usually completely unrecognized and uncared for by large families, she was under no necessity by law to cater to his whims. Second, no physical abuse nor torture were used. Third, bastards typically don't have any claim to their father's inheritance, so pressing that functionality of the law is not unlawful.

7) Guilty. Plea of insanity due to magic under consideration.

8) A) Guilty of pursuing the law without any due court. She had witnessed the man's crimes, she just did not have a court to recognize his guilt or innocence.

8) B) Lady Stoneheart herself was providing testimony.... and justice.

9) Guilty. Please of insanity due to magic under consideration.

It is to the views of this juror that the Lady Stoneheart has a natural tendency to practice justice without any recognizable authority. It is also this juror's view that due to the interferance of magical elements the Lady Stoneheart's executions may have some merit for a plea of insanity.

Due to this, the juror has very little idea what punishment would fit justice, as well as keep the security of the realm, and leaves the charge to the ruling court.

Not charging her with the murder of Jingle Bell is debatable, but I viewed Walder Frey as more accountable for the murder of Jingle Bell. Hence the reason I did not seek a charge against Lady Catelyn for the act.

Depends on letter of Westerosi laws, it could be argued this was a Citizen Arrest. However charge of Kidnapping probably applies as Lord Tyrion was not taken to the closest site capable of dispensing King's Justice. Guilty.

Charge 1B.-Lady Catelyn now know as 'Lady Stoneheart', led a band of outlaws known as 'The Brotherhood Without Banners' in the act of kidnapping and ransoming one Petyr Frey.

Lady Stoneheart is an undead abomination unto Nuggan... Err, unto Seven. Process has been known to damage mental faculties of the "revived" person. In the current state, the being formerly known as Lady Catelyn should be mercifully terminated, however it is NOT GUILTY on the base of insanity.

Not guilty. The full extent of Lady Lysa's mental state was revealed to the defendant only after Lord Tyrion was in Lady Lysa's custody and outside Lady Catelyn's reach.

To conceal and evade capture with her prisoner Tyrion Lannister, Lady Catelyn took her traveling party through the most dangerous region of the Vale. This act led to them being attacked by the Vale clansmen, endangering the life of her illegal captive.**After his acquittal of faulty charges initiated by Lady Catelyn Lord Tyrion had no choice but through a road in which capture by Vale Clansmen was imminent.

Guilty.

While Lady Catelyn cannot be held responsible for actions of brigands, she was aware of danger presented by travelling this road with insufficient escort. Even more seriously, she was fully aware f the possible results of sending Lord Tyrion with an escort of 1 the same way.

Lady Catelyn's actions of kidnapping Tyrion Lannister, provoked a military response by his father Warden of the West Lord Tywin Lannister. A response that would not have occurred had she not unlawfully seized Tyrion Lannister.

Not guilty. Especially since Lord Tywin was informed, that Lord Tyrion was detained on orders of King's Hand.

Judging Catelyn is tricky. I really don't see a point in combining her alleged crimes with those Lady Stoneheart committed. They really are two different people.

So let's start with Cat (the trial concerning LS will be quick).

1a) Guilty

2) Charges dismissed - Lysas crime not Catelyns

3) Guilty

4) Not guilty. Tywins actions were still illegal. Catelyn committed a crime and Robert should have judged her for that, not Tywin Lannister.

5) Guilty

6) Not guilty - Neither is she his mother nor was a crime committed.

Sentence: Death by the sword. That's the punishment for treason. Sorry, Cat.

Lady Stoneheart is found guilty on all charges. Death by the sword.

About the citizen's arrest argument. Catelyn herself questions her actions of kidnapping Tyrion with what she realizes is very flimsy evidence after Tyrion questions her about arming an assassin with his own dagger. So if she did not have the clarity to dissect such an important element in the accusation against Lord Tyrion, why she she have the power to place him under citizens arrest?

Tyrion never committed any crimes against the Vale, so in a legal sense once he reached the Vale Lysa had no legal right to hold him anyway. Further enhancing the prosecution claim that Cateyn lacked sufficient evidence to try Tyrion on charges she herself came to realize was faulty.

Objection: Lady Stoneheart is not a living person and should not be tried with Lady Stark, who died before Stoneheart was raised by magic. Only charges against Lady Stark should be considered. Would anyone propose charging the donors of the body parts of Frankenstein's monster with its crimes?

Dismiss, per objection above.

Charge 2-(Miscarriage of Justice) Because of said actions this court charges Lady Catelyn with a miscarriage of justice. Lady Catelyn invoked the Kings Justice and was not called upon by the king to lawfully carry justice out in his name. **Lady Catelyn was also advised by her uncle Blackfish Tully that her sister Lady Lysa of the Vale did not have the mental capacity to carry out justice in the kings name. His warnings were ignored even after Lady Catelyn saw Lysa's mental state first hand.

Guilty - Sentenced to imprisonment for three months.

Charge 3-(Reckless Endangerment) To conceal and evade capture with her prisoner Tyrion Lannister, Lady Catelyn took her traveling party through the most dangerous region of the Vale. This act led to them being attacked by the Vale clansmen, endangering the life of her illegal captive.**After his acquittal of faulty charges initiated by Lady Catelyn Lord Tyrion had no choice but through a road in which capture by Vale Clansmen was imminent.

Not Guilty - There is no evidence that Lady Stark was aware of the danger from the Vale clansmen. As Tyrion's "host", Lady Arryn was responsible for failing to provide transportation after his release.

Charge-4(Inciting riots/chaos/war) Lady Catelyn's actions of kidnapping Tyrion Lannister, provoked a military response by his father Warden of the West Lord Tywin Lannister. A response that would not have occurred had she not unlawfully seized Tyrion Lannister.

Dismiss - Lord Tywin is responsible for his own actions, He had many other potential responses to Lady Stark's actions other than initiating warfare against the Riverlands.

Charge 5-(Treason) Lady Catelyn unbeknownst to the King in the North negotiated with the enemy and agreed to terms without the kings knowledge. She released a prisoner of considerate value to the king and his allies "The King Slayer.' This court sites as precedence the trial of Alester Florent charge 3 'collusion'.

Not guilty - Only Robb Stark can decide whether disobeying his orders constitutes treason, and he did not declare it be so.

Charge 6-(child neglect) Lady Catelyn is accused of neglecting the child of her husband Lord Eddard Stark from the day he was brought to Winterfell. Lady Catelyn actively spoke against the victim Jon Snow's character when given the opportunity. This court sites as evidence the conversation between Lady Catelyn and The King in the North Robb Stark in which she sort(sic) sought to convince Robb against legitimizing his brother because he was a bastard and bastards are treacherous.

Charge 7-(Attempted Murder)-Lady Catelyn now known as Lady Stoneheart upon finding Brienne of Tarth and her companion Podrick Payne, ordered her band of outlaws to hang Podrick Payne, a young man with no prior knowledge or dealings with her. The act was only halted once Brienne of Tarth forcefully agreed to Lady Catelyn's terms.

Charge 8-(Murder)1A.-Lady Catelyn and her band of outlaws had no interest in ransoming Petyr Frey and hanged him by the neck until he was dead before their requested ransom was paid.

1B.-Despite his claims to have taken no part in the Red Wedding, Merret Frey was also hanged from the neck until dead while trying to pay the requested ransom for Petyr Frey. No effort was made by Lady Catelyn to corroborate or discredit Merret's claims of innocence in the act.

Charge 9-(Assault)-A charge of assault is warranted for her actions against Podrick Payne as severe bodily harm was done to him as a result of Lady Catelyn now known as Lady Staoneheart orders.

Dismiss charges 7 through 9 per objection above.

Overall sentence - 4 months imprisonment.

1A: Innocent, Lady Catelyn had word from a high ranking government official that the weapon used in the attempted murder of her son belonged to Tyrion Lannister. This was enough to constitute reasonable suspicion that Tyrion was connected with the attempt and therefore his arrest was justified.

1B: Innocent, The Brotherhood without Banners was a paramilitary organization who were engaged in open warfare with enemies of the crown, including House Frey. The capture of Petyr Pimple was the equivalent of taking a prisoner of war.

2: Innocent, despite Lady Lysa's mental state, both Lady Catelyn and Ser Brynden were on hand and were able to ensure proper procedure during the trial. And the trial was carried out according to established precedent without objection from either party.

3: Innocent, the High Road was the only viable land route to the Eyrie. Lady Catelyn had no choice in the matter.

4: Innocent, Tywin's military response towards the Riverlands was a vastly disproportionate response to Tyrion's arrest.

6: Innocent, Lady Catelyn had absolutely no legal or moral obligation to care for the illegitimate son of her husband.

8B: Not Guilty, Lady Catelyn was an eyewitness to Merrett Frey's involvement in the Red Wedding and therefore no further evidence was needed to prove or disprove his involvement.

I sentence Lady Catelyn Stark to imprisonment, she is to remain under house arrest in her apartments in Riverrun. Additionally she must also repay the Freys the 100 gold dragons that were paid to the BwB which were intended to be ransoms in exchange for the release of their Frey hostages.

I hereby find Lady Catelyn innocent of all charges except for the kidnapping of Tyrion Lannister. While Tyrion was taken without any hard evidence, Catelyn was led to beleive by Petyr Baelish that the dagger found was Tyrion's. Thus, she must pay a monetary fine only of 1000 dragons. As well as this, an extra 1000 dragons for endangering his life while he was her hostage in the Mountains of the Moon and letting him return from the Eyrie unescorted.

Objection: Lady Stoneheart is not a living person and should not be tried with Lady Stark, who died before Stoneheart was raised by magic. Only charges against Lady Stark should be considered. Would anyone propose charging the donors of the body parts of Frankenstein's monster with its crimes? Denied, they are the embodiment of the same person.

Guilty - Imprisonment for at least the same length of time as Tyrion was held captive.

Dismiss, per objection above.

Guilty - Sentenced to imprisonment for three months.

Not Guilty - There is no evidence that Lady Stark was aware of the danger from the Vale clansmen. As Tyrion's "host", Lady Arryn was responsible for failing to provide transportation after his release. I challenge this argument, since you flat out ignored

the evidence of them being attacked on their journey to the Vale. It is reasonable to think that her captive would face danger leaving the Vale.

Dismiss - Lord Tywin is responsible for his own actions, He had many other potential responses to Lady Stark's actions other than initiating warfare against the Riverlands. Actions brought on by the illegal capture of his son, actions that this court has already held him accountable for. We are now trying Lady Catelyn, not Tywin Lannister so address her charges.

Not guilty - Only Robb Stark can decide whether disobeying his orders constitutes treason, and he did not declare it be so. The rules of this thread state that we do not recognize the prior judgement of any other court, ruling body or kings etc. Read the rules next time.

Unless he was an active participant in the RW and condemned for it. Charges dropped because of doubt.
