sologdin Posted January 18, 2006 Share Posted January 18, 2006 re: basic copyright (i.e., non-cyberlaw)-- section 106(2) of the copyright act grants the CR holder the exclusive right to prepare "derivative works," which are those works "based on" a copyrighted work, and somehow alter it, then redistirbute it. from the section 101 definition: "a work consisting of editorial revisions, annotations, elaborations, or other modifications which, as a whole, represent an original work of authorship, is a derivative 'work'." i.e., this is likely a derivative work-in-progress. the fair use defense would still apply to any infringement of the section 106(2) rights. fair use analysis has four components: a) purpose and character of use – commercial or non-profit? nature of copyrighted material? c) amount and substantiality of CR work taken? d) market effect d) is probably the most important; but under a), for-profit use is likely presumptively unfair. for , the main distinction is fact v. fancy i.e., is one using 100 pages of data from scientific tables, or 100 pages of james joyce? for c) there is no straight percentage; rather, e.g., 300 words is enough to damn one as an infringer (this happened to the nation, when they published the juiciest bits of president ford's memoir in a review). on the other hand, larger amounts of non-substantial stuff could be used. the standard is an abstract "no more than reasonably necessary"; i.e., ran's point above seems generally correct. all of this might be enough to protect the activity here thusfar, without raising the issue of parody--which is likely enough. if anyone is really interested, one should speak with a copyright attorney who knows recent cyberlaw developments.
